The preservation of air and water quality is at the heart of maintaining a safe environment. It has therefore been the responsibility of the Department of Environmental Quality, through state statute, to "ensure a safe and healthy environment for all residents, maintain healthy ecosystems needed for the development of tourist activities and promote economic development." Standards have been set by the Clean Air Act and the Clean Water Act for the acceptable level of contamination to both air and water before they are determined unsafe. Since the boom of federal environmental laws in the early 1970s, Congress, federal administrative agencies, and the states have grappled with how best to obtain the lofty goals of these laws. The implementation of environmental policy initiatives often brings about a complex interplay between science and policy, public opinion, interest groups, federal and state mandates, and political machination. Jon Reisman uses Maine’s recent experience of compliance with the 1990 Clean Air Act to illustrate this complexity. In doing so, he addresses several important, but often ignored, issues, such as stakeholder participation in the policy making process, interest group accountability to implementation, and the long term consequences to the environment if these issues are avoided.

Increasing environmental regulation has resulted in an antiregulation backlash and the growth of a property rights movement. Unable to successfully use the courts to protect private property from diminution in value due to government regulations, property rights advocates have looked to the federal and state legislatures for assistance. This has led to some states and the United States Congress to introduce private property rights protection. This protection generally takes one of two forms. The first requires the government to assess the possible effect on property rights before enacting regulations. The second requires the government to compensate property owners for the …
