On Protecting Accountability, Eric M. Freedman

Hofstra Law Review

Today's subject, whether a sitting President may be indicted, is one that I have addressed in print over many years, dating back to the Nixon Administration. Since it contains a good deal of additional legal and historical data backing up the principal points I will be making, I hope you will read it in full (or at least refer to its …

Perjury As A Ground For Impeachment-A Textual And Contextual Analysis, Monroe H. Freedman

Hofstra Law Review

The Impeachment Clause of the Constitution provides that the President, Vice-President, and all civil officers of the United States shall be removed from office on conviction of "Treason, Bribery, or other high Crimes and Misdemeanors."' During the impeachment proceedings against President Clinton, a repeated contention was that the crime of perjury falls within this Clause. The modest thesis of this paper is that it does not-that the crime of perjury is not of the same general category as treason and bribery within the meaning of the Constitution.'

How To Read A Statute In New York: A Response To Judge Kaye And Some More, Eric Lane Jan 1999

How To Read A Statute In New York: A Response To Judge Kaye And Some More, Eric Lane

Hofstra Law Review

New York's and all judicial approaches to statutory interpretation are framed by the constitutional truism that the judicial will must bend to the legislative command. Such legislative superiority means that, in the application of statutes, judges are not free to resolve a dispute by simply imposing their outcome preferences, as they might have done in a common law setting, or to treat statutory laws as loosely binding precedents, as they may have treated common law precedents. In "question[s] of statutory interpretation ... the Court's role is clear: our purpose is not to pass on the wisdom of the statute or …
