Foreclosure Of A Deed Of Trust In Virginia, Doug Rendleman

This article deals with foreclosure of a deed of trust in Virginia.
The Introduction discusses the deed of trust or mortgage as a social
and political institution and the foreclosure crisis that seems
to be ending. Part I is a brief history of mortgage law. It provides
a short history of the modern mortgage system in the United
States. Part II follows with a description of the approach that
Virginia takes to mortgages. It localizes the mortgage institution
to Virginia and introduces Virginia's vocabulary and technical details,
the deed of trust, and the parties' rights and obligations.

From Mainstreaming To Marginalization?--Idea's De Facto Segregation Consequences And Prospects For Restoring Equity In Special Education, Kerrigan O'Malley

Part I of this comment provides an overview of IDEA provisions and implementation regulations followed by a review of judicial interpretations in landmark IDEA service delivery cases, specifically the Supreme Court's Rowley ruling. Drawing upon both le-gal and educational scholarship, this analysis then assesses how IDEA's aspirational equality goals ultimately devolved into de facto segregation in special education. Part II considers factors resulting from the Supreme Court's tuition reimbursement rulings that trend away from IDEA's original equality purpose and integration preference to compromise equality in four ways: creating a means-based bias in private school placement; undermining IDEA's cooperative paradigm and …

This article surveys recent significant developments in Virginia civil practice and procedure. Specifically, the article discusses opinions of the Supreme Court of Virginia from June 2010through June 2011 addressing civil procedure topics; significant amendments to the Rules of the Supreme Court of Virginia concerning procedural issues during the same period; and legislation enacted by the Virginia General Assembly during its 2011 session that relates to civil practice.
