Studying Music, Learning Law: A Musical Perspective On Clinical Legal Education, Alfred C. Aman

I want to talk about an important issue in legal education today: the role of clinical education in the law school curriculum. I hope to shed some light on that issue by looking at another professional school model-not the medical school model, which is the usual approach, but the music school model. I want to reflect on my experiences as a student at the Eastman School of Music and my recent conversations with Robert Freeman, the director of the Eastman School, and members of the Eastman faculty. The papers in this symposium examine constitutionally significant separation-of-powers themes that were particularly controversial in Franklin Roosevelt's administrations and once again command our attention. The Supreme Court's decision in cases such as Immigration & Naturalization Services v. Chadha I and Bowsher v. Synar2 have helped to resurrect questions that have been ignored, if not resolved, since the 1930s. This symposium focuses on the contemporary debate that these issues have generated, and it provides us with an array of approaches to and perspectives on that debate. In Western civilization, a rationally ordered universe and human rationality are the central tenets of theology and moral philosophy. Conceptions, values, and principles implied by these premises have become entrenched in social and legal institutions. Concluding that religious teachings, even those of antiquity, are consistent with modern legal principles is reasonable, and almost common sense. An inquiry into whether this relationship is to any extent causal is fascinating. Professor Jerome Hall, the first President of AMINTAPHIL, discusses the relationship between the Christian doctrine of atonement and principles of modern criminal law.
