I intend to consider the practical value of the various means aiming at the prevention of war that have been suggested or put into effect since 1919. Why since 19197 I do not think that international law was created in 1919. But, whether one wishes it or not, an effort, unprecedented until now, has been devoted to the study of the technique of peace. The struggle against war is no longer limited to sentimental effusions, or fireside dreams: it has become an object of science; even of applied science. Some time ago the writer published an article1 dealing with the common law declaration in West Virginia, the general purpose of which was to collect and analyze the local statutes modifying or dispensing with common law requirements and to determine what further might be done by way of statutory reform. It is now proposed to deal with some of the features of common law pleas and the subsequent pleadings somewhat in the same manner and with the same general purpose in view. One who undertakes a discussion of the doctrine of last clear chance need make no apologies to those who have had occasion to inquire, even superficially, into the subject. The perfectly bewildering assortment of cases in West Virginia applying the principle indiscriminately under the guise of proximate cause, supervening negligence, or wilful negligence, point to the necessity for an attempt at clarification. It is the purpose of this article to make that attempt, to analyze the reported cases, pointing out those believed to be incorrectly decided, and to submit definite classifications and rules of application tending to produce rational decisions …
