Executive Overview • This article determines the frequency and outcomes of published court decisions under the IDEA for students from pre-K through grade 12, starting in January 1998 and ending in October 2012. • The frequency of these decisions trended upward during the 15-year period, particularly during the most recent five-year interval. • The conclusive outcomes favored districts on a 3:1 basis both overall and on relatively consistent longitudinal basis; however, the intermediate outcomes partially ameliorated this pronounced pro-district tendency. • The Second Circuit region (New York, Vermont, and Connecticut) had the highest volume of cases, and the Tenth Circuit …

The authors describe their attempt to develop students’ critical perspectives on the content and assumptions in the 2008 Florida Principal Leadership Standards (FPLS) through a reflective essay assignment in a class titled Ethics, Equity, and Leadership in Education. The authors conducted textual analysis of 92 student essays (a total of 922 pages) submitted in 5 sections of a class from the summer of 2008 through the spring of 2009. The authors describe ways students analyze knowledge claims in the FPLS in relation to the standards’ considerable silence around issues of ethics and equity, which were central to the class: 1) …

We conducted a content analysis of 34 statements of interest submitted by applicants applying to an education leadership preparation program. The purpose of the analysis was to understand the applicants’ orientations toward social justice. Using Kumashiro’s (2000) and Apple’s discussions of anti-oppressive education, we identified three practices in the candidates’ treatment of the writing prompt concerning leadership related to Othering: ignoring, marginalizing, and mentioning. The fourth practice, embodying (evidencing through practice) a social justice orientation, was a practice we identified in statements submitted by a few applicants (n=7). This article centers on the analysis of the applications of these seven …

A Study Of Group Dynamics In Educational Leadership Cohort And Non-Cohort Groups., Zorka Karanxha, Bobbie Greenlee
Zorka Karanxha
The purpose of this study was to examine group dynamics of educational leadership students in cohorts and make comparisons with the group dynamics characteristics of non-cohort students. Cohorts have emerged as dynamic and adaptive entities with attendant group dynamic processes that shape collective learning and action. Cohort (n=42) and non-cohort (n=51) students were surveyed on group variables of participation, communication, influence, trust, cohesiveness, empowerment, collaboration, and satisfaction. Descriptive statistics and effect size analyses were used for data analysis. Significant differences were identified in trust, cohesiveness, and satisfaction. However, findings show little effect on cohort structures in the areas of participation, …

This chapter provides a concise and up-to-date synthesis of the published case law where a student teacher was the plaintiff, the defendant was an institution of higher education or cooperating local school district, and the issues in dispute were related to diversity. The number of such court decisions was surprisingly small, and the outcomes generally favored the defendant institutions. The court cases fall under three categories: 1) student teachers’ diverse views on religion, 2) student teachers’ diverse forms of free speech, and 3) student teachers with special needs. Constitutional claims were the predominant avenue of litigation against school districts and …

Child abuse and neglect is a troubling issue all too familiar with courts in the United States. The problem becomes even more complicated when substance abuse is involved. In 2004, approximately 500,000 children were removed from their homes because of abuse and neglect issues1. In the past few years, a judicial model appeared to address both substance abuse and child dependency issues. This model, entitled Family Dependency Treatment Court (FDTC) enables the court to mandate treatment for parents and make reunification dependent on treatment compliance. The FDTC program in Hillsborough County, Florida is now in its second year and has …
