Moving Beyond The Standard Criticisms Of Design Patents, Sarah Burstein

The U.S. design patent system has been widely criticized. Certain arguments against design patents have been made so often--and accepted so uncritically--that one might believe that the case against design patents was overwhelming and that the failure of the system was beyond dispute. These standard criticisms can be grouped into three main categories: (1) designs aren't patent subject matter; (2) patent requirements are not "appropriate" for designs; and (3) patent protection is overbroad. This article examines each of these standard criticisms and concludes that they are not persuasive. Therefore, the case that is commonly made against design patents is not …

ABSTRACT Drawing from my almost thirty years of law practice experience, it is my belief that clients are looking for an attorney who will communicate effectively with them, focus on their situation and give them an assurance that the attorney will use his or her expertise to the client’s benefit to achieve the best possible result. Client concerns reflect a humanity of relationship, an affective dimension, that is stifled in traditional doctrinal instruction. ABSTRACT: This paper is written and submitted by Peking University (Beijing University) Center for Real Estate Law, Director, Prof. Lou Jianbo, and Assistant Director, Prof. Joyce Palomar, authors. The paper examines the People's Republic of China's national approaches beginning in 1948 to the nation's urban housing crisis.
