I would like to use as the launching pad for my remarks today the 1989 federal district court decision in Doe v. University of Michigan. Doe is the seminal case on campus speech codes and it just recently passed its twenty-fifth anniversary. Conside the following case: The patient is a 44-year-old woman who presents for radiation treatment of an isolated locoregional recurrence of breat cancer in her chest wall, 3 years after undergoing masectomy. At the time of diagnosis, she had T2N2M0 disease, with four of 15 lymph nodes involved with tumor. She received a masectomy with negative margins and appropriate chemotherapy, but none of her physicians talked to her about postmasectomy radiation therapy, which would clearly have been indicated to reduce her risk of locoregional failure and would have been expected to improve her likelihood of survival. Many people have suggested that the recent battle over affirmative action was a defining moment for the contemporary relevance of Brown v. The graduate schools of elite American universities, Daniel Bell wrote not many years ago (though before "elite" had become a term of opprobrium), stand at the center of their parent institutions, a position from which they dominate not only American higher education but, increasingly, the intellectual life of the nation. Michigan was, of course, high on Bell's list of elite universities, and it is, therefore, fitting that we mark the fiftieth anniversary of the establishment of its graduate school as an occasion worthy of celebration.

The present year has witnessed the final step in the establishment of the new entrance requirement to the Law Department which was undertaken by the Faculty and Regents several years ago. This, in effect, provides that every student in the Law Department from now on shall have had at least one year in the Literary Department, or its equivalent elsewhere, and places the course of the Law Department practically upon the four year basis of the other schools in the University.

This is Judge Cooley's tribute to former University of Michigan astronomer Professor James Craig Watson, who died unexpectedly at age 42 and is buried in Forest Hill Cemetery in Ann Arbor. While not specifically related to the law, Cooley memorializes Watson with his ringing prose: "... it was among the stars this great man found his chief delight, and fitting it was that he should do so.
