The rule of law is often difficult to establish in developing nations characterized by frequent political changes and unstable events that affect the separation of powers between the three branches of government – the executive, legislature, and judiciary. In particular, the integrity of the judiciary is often damaged by influences from the executive and legislative branches in that core democratic principles are promoted, including civil liberties, the supremacy of law, law and order, and transparency and accountability among government actors. This paper examines aviation security approaches in Canada and the United States. After the 9-11 attacks, several new aviation security measures were introduced by both nations (including legislation and policies) in order to secure the aviation sector from terrorist attacks. The thesis of the paper is that Canada and U.S. promote security and commerce within a multi-layered regime within a federal regulatory framework. Various pieces of legislation and policies are discussed, including the role that federal agencies play in working with other agencies to enhance security on the ground and in the air. In the wake of the 9-11 attacks, several nations have introduced security legislation in various forms that affected their immigration system. Security certificates are administrative tools designed to safeguard the national security of Canada by detaining individuals suspected of having links to terrorism or other forms of serious criminality. This form of detention has provided few due process rights for accused non-citizens, forming the basis of much criticism.
