While Texas homestead law has provided a great degree of protection for homeowners in the past, the rising power of the Homeowners' or Property Owners' Association is placing that protection in jeopardy. Over the past 20 years, associations have grown in number and power. This article covers a very current and relevant topic in today’s legal environment. Previous articles have merely discussed competing models or coverage of the disputes in the case law. My article embarks upon a comprehensive look at the specific problem presented and then goes on to offer a specific model with proposed legislation to address these disputes in a fundamentally more efficient manner.
