Disproportionate Representation Of Minority Youth In The Juvenile Justice System: A Lack Of Clarity And Too Much Disparity Among States "Addressing" The Issue, Elizabeth N. Jones

This article explores how states are struggling to reduce the overrepresentation of youth of color in their juvenile justice systems by complying with the federal Juvenile Justice and Delinquency Prevention Act. The JJDPA provides funding for states following its directive to identify, assess, and reduce the disproportionate contact by minority youth with the juvenile justice system. This article queries whether the JJDPA is an effective instrument with which to seek racial parity for minority youth who are already “in contact” with the juvenile justice system. This article addresses teen sexting from a First Amendment vantage point. It considers adolescent cognitive development, finds authority for a sphere of teen sexual privacy encompassing teen sexting images and advances the application of a variable strict scrutiny standard to insure the constitutionality of teen sexting legislation.

Although precise estimates do not exist, the data suggests that the number of children believed to be at risk for commercial sexual exploitation in the United States is between 200,000 and 300,000 and that the average age of entry is between eleven and fourteen, with some as young as nine. The number of prostituted children who are criminally prosecuted for these acts is equally difficult to estimate. In 2008—the most recent year for which data is available—approximately 1500 youth under age eighteen were reported to the Federal Bureau of Investigation as having been arrested within United States borders for prostitution …
