Immigration Law Forces Foreign Doctors To Return Home

Many foreign doctors come to the United States to complete advanced medical training unavailable in their home countries. It is not unusual for a foreign doctor to desire to remain in the United States after completion of that training.The Immigration and Nationality Act (INA) presents a major obstacle to this desire by requiring the doctor to return to his or her home country for two years after the completion of training in the United States. Many subject to this obligation will want to create a strategy to either avoid or ease fulfillment of this requirement. The options are limited, but, …

This article discusses the political, legal and cultural similarities between the United States and Australia. It ties in the experience of the author in living both these countries and as an immigration attorney.
As an introduction, this article notes that Australia and the U.S. have many common traits. Both Australia and the U.S. are termed “immigrant nations” because the vast majority of what constitutes the populations in the current political entities of the “Commonwealth of Australia” or the “United States of America” are immigrants. Nativism - an intense opposition to immigrants and other non-native members of society - has been deeply imbedded in the American character from the earliest days of the nation. Dating from the Alien and Sedition controversy of 1798 to California's recent Proposition 187, nativism has long been a driving force in policy making, a particular irony in a country founded and populated by immigrants.

Introduction: An alien lawfully enters the United States in 1972. He gets a job, gets married, and becomes a productive worker in the community. He is subsequently convicted of a felony, such as making false statements on a loan application. As a result, the Immigration and Naturalization Service (INS) brings deportation proceedings against him.
