The spirit of Alexander the Great still stirs ghosts between Greece and the Republic of Macedonia. Macedonia is on its way to the EU and Greece represents an obstacle for these processes in the aftermath of the name dispute and the Greek veto on the Macedonian membership in NATO and the European Union. This article conducts a brief historical excursus on the evolution of the EU’s readmission policy through the analysis of readmission agreements, meant as its main legal instruments. The Lisbon Treaty is herein portrayed as an historical watershed in the recognition of both an express competence of the Union with regard to measures aimed to address the readmission of irregular migrants, and a new role of the Parliament entrusted with the fundamental power to be consulted before a readmission agreement is definitively concluded by the Council. The article takes a thorough look at the national legal framework concerning registrations in the National Record of Undesirable Foreigners and the Schengen Information System (SIS) within the context of the Schengen Agreement (1985) and the common rules adopted by the participating States. It analyzes the nature and implications of the actual administrative act of registration for foreign nationals in light of the pertaining domestic case law. A critical approach of the harmonization of Greek legislation to the Schengen rules is also being attempted.

In line with current tendencies of ‘new modes of governance’, this essay introduces judicial tools, which strike a balance between the respect for national autonomy in individual assessments and the effective implementation of Community law. The balance is struck through the demands of structural guarantees; administrative safeguards, which weed out arbitrary national decision-making. These administrative safeguards are particularly needed in areas where the Member States of the EU have been granted a wide margin of discretion.

This paper contains short summaries of two main speeches made during the NELN+ Conference in Lund in October 2011. The first speaker, Nicolas de Sadeleer from Belgium, talked about the issues of precautionary measures in situations of scientific uncertainty. He presented an overview of the relevant EU case-law from the General Court and the Court of Justice. Under the point of view of restitution law, the proposal on a CESL, part VII, draws a parallel between terminated and avoided contracts, which is much more convincing than the binary model followed by the DCFR. It is, however, necessary to make this set of rules consistent with the general principle of unjustified enrichment, which according to European law represents its underpinning. In the article, a series of corrections are suggested to reach that goal.
