“Inducing” Copyright Infringement In Canada: Is It A Thing?, David Vaver

Is there such a thing as “inducing” copyright infringement? There isn’t in the United Kingdom, but the Federal Court in Bell Canada v L3D Distributing Inc (INL3D) 2021 FC 832 (“L3D Distributing”) thought there was in Canada and the defendants had done it. Indeed, the court thought that inducing infringement, which to date had been considered wrong only in respect of patents, applied to all forms of intellectual property (“IP”).

The corporate world is a site of legally created irresponsibility.

Our four-year-old had an invisible friend, Kim. She and Kim invited us to a tea party.

Obligingly, we passed cookies and a cup to Kim. Our daughter carelessly dropped a cup. Afraid, and imaginatively, she said that Kim had done it. We told her that pretence had its limits. We had to teach her that all of us are to take responsibility for our conduct and actions taken on our behalf.

That is the moral glue that holds society together. Unless you find yourself in the corporate world.

According to a recent analysis, close to 900 climate-change cases have been filed in “24 countries and in the European Union, with 654 cases filed in the U.S. and over 230 cases filed in all other countries combined,” as of March 2017.

So far, many of these cases have been filed against government entities, either for their failures to regulate consistent with their rhetoric in international negotiations, or for failing to protect their citizens’ health and future prospects according to long-standing, common law public trust doctrines.

Over 20,000 people from the mining industry gathered in Toronto for the annual conference of the Prospectors and Developers Association of Canada last week. This is known as one of the largest mining conferences in the world and reflects Canada’s worldwide dominance in the mining industry.

However, some Canadian mining companies have come under criticism for human rights violations associated with their projects overseas. Most recently, the Justice and Corporate Accountability Project released a detailed report documenting over 400 people harmed, including over 40 deaths over a 15-year period, in Latin America alone, associated with Canadian mining activity. The Commissioner of the Financial Consumer Agency of Canada (FCAC) is seeking comments on three proposed guidance documents it has published to assist with the implementation of new disclosure requirements set out in the April 2015 update to the Code of Conduct for the Credit and Debit Card Industry in Canada (the Code). Submissions to FCAC regarding the draft guidance documents are due April 15, 2016.
