The Right To Competent Counsel In Special Courts Martial, Edward F. Sherman

The special court martial is the intermediate court of the Armed Forces, with jurisdiction over any noncapital offense under the Uniform Code of Military Justice. Counsel in special court martial cases need not be lawyers, and in fact few of them are in special courts martial of the Army and the Navy. Mr. Sherman argues that the time has come to change this practice and ensure that servicemen are always represented by competent lawyers at such trials.

The law of theft has long been the most complicated branch of the criminal law, writes Mr. Hall, and this is so in the face of the fact that crimes against property can he estimated safely as accounting for 90 per cent of all genuine crime in this country. The Model Penal Code has done much to simplify the law of theft and to eliminate outmoded distinctions, the author concedes, but he maintains that distinctions still must be recognized among the various types of theft, the persons involved in theft and the appropriate penalties for various crimes against property. Some Observations On The Law Of Water Allocation As A Variable In Industrial Site Location, Sheldon J. Plager

The availability of a water supply is of vital concern to industry. This availability may be affected as much by the applicable legal doctrine as by the accessibility of an adequate water supply. Professor Plager explores the two major riparian doctrines that apply to surface water supplies: "natural flow" and "reasonable use." He concludes that, although the theoretical differences between the two doctrines are often blurred, practical differences are present.

Interference With The Public Right Of Navigation And The Riparian Owner's Claim Of Privilege, Sheldon J. Plager

Entering a navigable body of water from the upland, and navigating from the point of access to distant points on the same body of water or points on connecting bodies of water, are, for practical purposes, a continua­tion of the same act. Yet they involve significantly different legal concepts and raise significantly different issues. The problems resulting from inter­ference with a riparian owner's right of access to and from his upland are examined in Part I of this article; those involving his right to travel once he has obtained access are the subject of Part II.
