Labor And Industrial Relations Workers' Compensation: Amend Certain Provisions, Lisa Kabula

The Act changes various provisions of Georgia's workers' compensation law. In particular, the Act redefines those who are presumed to be totally dependent upon an employee who dies as the result of an on-the-job accident. Further, it authorizes no-liability stipulated settlements between parties, to be approved by the Board of Workers' Compensation. The Act also authorizes agreements for lump sum settlements that are prorated over the life expectancy of the injured employee. The Act increases various statutory maximum and minimum workers' compensation payments. It also provides electronic fund transfer as an option for paying benefits.

The Act makes a variety of changes to Georgia's workers' compensation law. First, the Act increases the penalties to be paid by employees who fraudulently retain income benefits to which they are not entitled. The Act also amends the workers' compensation law as it applies to administrative hearings by: (1) allowing the admission of laboratory reports when accompanied by an affidavit from the laboratory, which eases the authenticity requirements, and (2) making the time requirements set forth in title 24 of the Code inapplicable to workers' compensation proceedings. The Act amends several aspects of the workers’ compensation system. First, the Act makes several changes affecting legal action under the Workers’ Compensation Act, including changes affecting employer’s subrogation liens, the admissibility of certain evidence, and required mediation. Second, the Act attempts to eliminate fraud in the area of workers’ compensation by imposing heavier penalties and by establishing a fraud and compliance unit within the Workers’ Compensation Board. Furthermore, the Act includes the Workers’ Compensation Truth in Advertising Act of 1995 to assure truthful and adequate disclosure in all advertisements relating to workers’ compensation. The Act provides that all persons who perform voluntary service for the Atlanta Committee for the Olympic Games or for the Atlanta Paralympic Organizing Committee will be considered employees of the organization for the purpose of workers’ compensation coverage.
