Sexual Abuse Of Female Inmates In Federal Prisons, Brenda Smith

Congressional and Other Testimony

This Article discusses the modest aspirations of the Prison Rape Elimination Act (“PREA”) that passed unanimously in the United States Congress in 2003. The Article posits that PREA created opportunities for holding correctional authorities accountable by creating a baseline for safety and setting more transparent expectations for agencies’ practices for protecting prisoners from sexual abuse. Additionally, the Article posits that PREA enhanced the evolving standards of decency for the Eighth Amendment and articulated clear expectations of correctional authorities to provide sexual safety for people in custody.

Economic research establishes that market power is now a serious problem. Growing market power harms consumers and workers, slows innovation, and limits productivity growth. Market power is on the rise in a number of major industries, including, for example, airlines, brewing, and hospitals, where multiple horizontal mergers that were allowed to proceed without antitrust challenge have markedly increased concentration in important markets and facilitated the exercise of market power. This document is the written testimony submitted to the U.S. House of Representatives, Committee on the Judiciary, Subcommittee on the Courts, Intellectual Property, and the Internet. My testimony examines the authority of federal district courts to issue nationwide injunctions, defined as injunctions that bar the defendant from taking action against individuals who are not parties to the lawsuit. Such injunctions have been used frequently over the past few years to halt executive policies, particularly in immigration cases.
