This model legislation consisting of ten separate provisions is intended to clarify and/or expand existing Maine law dealing with planning and land use regulation. It expands existing statutes by addressing a number of issues not presently covered by law. The overarching purpose of the proposed legislation is to underscore that planning and the imposition of land use regulations is not exclusively the responsibility of local governments but instead is a shared duty of the state and local governments. This is clearly stated in the text and commentary of Provision I, and is a theme that pervades all ten legislative proposals. …

This Article develops ideas and arguments relative to judicial funding initially advanced by this Author in two op-ed pieces previously published in the Maine Lawyers Review. Beyond elaborating and more carefully documenting (with footnote references) points previously made, this Article undertakes to lay out the judicial department’s unique status as one of three co-equal and coordinate branches of Maine’s governmental structure. It is this status that separates the judicial department from all of the other agencies of state government. There is a drug epidemic sweeping the State of Maine and it continues to worsen each passing year. In 2017, the Maine legislature passed Public Law Chapter 488 to strengthen the controlled substance prescription monitoring program. An outpatient pharmacy, located in a large acute care hospital, created a performance improvement project to clarify opioid prescription and resolve any non-compliance with Chapter 488.

After a root cause analysis, several KPIs were established to include tracking the number of phone calls made by pharmacists to non-compliant providers to clarify scripts, provide one on one education and ultimately resolve non-compliance. Repeat offenders were …

In Maine, juvenile appeals are governed by the Maine Juvenile Code and the Maine Rules of Appellate Procedure. The Juvenile Code broadly dictates the types of rulings that a juvenile may appeal, and the Appellate Rules set out the details of how the appeal must proceed in the Law Court.

The Juvenile Code divides appealable rulings into five categories: adjudications, dispositions, detention orders, orders of deferred disposition, and bind-over orders.[1] An adjudication is appealable to the Law Court by right, as long as the appeal is taken after an order of disposition.[2] An order of disposition or any …

The battle between Governor Paul LePage and the Maine legislature in the summer of 2015 was one of the most contentious – and strangest – in state history. Hanging in the balance were over sixty pieces of legislation that the Governor insisted had been vetoed, and which senators and representatives of both parties claimed had become law. To resolve the issue, the Governor turned to the state Supreme Court, which unanimously decided in favor of the legislators in a nonbinding “Opinion of the Justices.” This case note explores that opinion, and comes to the conclusion that while the Court arrived …

This Note considers the longstanding clash between the United States government and state governments over the management of intrastate waters through the lens of Maine v. McCarthy, an ongoing federal lawsuit. McCarthy confronts whether the United States Environmental Protection Agency can require state water quality standards to specifically safeguard the health and cultural practices of Maine’s Indian tribes, particularly sustenance fishing. A panoply of legal and political factors gave rise to and shaped the course of the litigation, ranging from tribal sovereignty to agency discretion and political gamesmanship.
