Many law students come to law school after being indoctrinated by television and movies, believing that an effective lawyer must be obstreperous, obnoxious, and rude to be successful. Lawyers, they believe, must fight their opponents on every point at every corner if they want to represent their clients zealously and adequately.

Law students must recognize that incivility by lawyers can lead to significant negative consequences for the client, the attorney herself, and the legal system. Law students must also understand that lawyers can treat opposing counsel with civility while still providing robust, vigorous, and adversarial representation for their clients. This …

Lawrence Yealue is the West Africa Representative of Accountability Lab, an incubator for local-level integrity initiatives with an emphasis on generating sustainable development. Based in Monrovia, Liberia, Yealue’s career has centered on community-driven approaches to responsible reform. His previous work includes serving as Electoral Commissioner for the Liberian Student Association-Ghana, National Coordinator for the World Youth Spirit Council, Project Director for the Rotary Club of Wisconsin, and as a volunteer for Africa Peace’s HIV/AIDS Education & Peace Initiative. This essay uses the Australian proactive approach to regulating attorneys as a springboard to discussing the role of proactive regulation of lawyers in advancing public protection. The essay provides information on the genesis and implementation of “proactive management-based regulation, the system in Australia. The essay reviews key research findings from empirical studies on the impact of the new system on complaints registered against lawyers and the conduct of lawyers in firms. The essay suggests possibilities for using management-based principles to improve lawyer regulation and conduct in the United States and other jurisdictions.
