Organophosphates, Friend And Foe: The Promise Of Medical Monitoring For Farm Workers And Their Families, Adriane J. Busby, Gabriel Eckstein
Faculty Scholarship
Millions of farm workers nation-wide who load, mix and/or apply pesticides are exposed to incredible amounts of pesticides on a daily basis. Various inefficiencies and inconsistencies in the regulatory system - including insufficient illness reporting data systems, lack of regulatory compliance and enforcement, and inadequate data and information on the chronic effects of exposure and overexposure to various pesticides - increase the likelihood that these workers will continue to be exposed to dangerous amounts of pesticides.
This Article assesses the existing mechanisms designed to protect farm workers from occupational exposure to pesticides and identifies and analyzes some of the shortcomings …
Shifting The Paradigm: Broadening Our Understanding Of Agriculture And Its Impact On Climate Change, Annise Maguire
Shifting The Paradigm: Broadening Our Understanding Of Agriculture And Its Impact On Climate Change, Annise Maguire
Annise Maguire
Scientists have determined that the Earth is warming at an unprecedented rate. Governments around the world are in near unanimous agreement about the existence of climate change and the threat it poses. Further, there is a growing consensus within the global scientific community that the primary cause of climate change is increased emissions of greenhouse gases (GHGs) related to human activities. At best, it appears that human actions are exacerbating the natural heating of the earth; at worst, humans are the primary cause of the rapid rise in temperatures.
Unfortunately, policies enacted to date have failed to take into account …
A Troubled Path To Private Property: Agricultural Land Law In Russia, Ira Kenneth Lindsay
A Troubled Path To Private Property: Agricultural Land Law In Russia, Ira Kenneth Lindsay
Ira Kenneth Lindsay
When the Soviet Union collapsed many observers hoped that decollectivization would improve the infamously inefficient Soviet agricultural sector and raise collective farm workers out of poverty. The initial results of market reform in Russian agriculture were a severe disappointment in both respects. Under Putin, Russia has finally allowed agricultural land to be bought and sold. The effects of this latest reform have been less than was hoped by supporters or feared by opponents. Russia’s experience with land reform suggests that while private ownership of farmland may offer significant advantages, successful land reform requires much more than the creation of legal …

According to International Labour Organization (ILO) statistics, more than 70 percent of all child laborers work in agriculture. From tending cattle, harvesting crops, to handling machinery or holding flags to guide planes spraying pesticides, more than 132 million girls and boys, aged 5 to 14, help produce much of the food and drink people consume, as well as fibers and primary agricultural materials. ILO also notes that, of course, the numbers vary from country to country but it is estimated that at least 90 percent of economically active children in rural areas in developing countries are working in agriculture. However, …

The Legal Needs Of Farmers: An Analysis Of The Family Farm Legal Needs Survey, A. Bryan Endres, Stephanie B. Johnson, Donald L. Uchtmann, Anne H. Silvis
A. Bryan Endres
In post-modern agriculture's increasingly complex operating environment, the literature lacks a comprehensive analysis of the legal issues facing today's farm operators from the perspective of the farmer. Numerous scholars (included the authors) have analyzed various specific legal/policy issues and their impact on the agricultural community. This article, however, adopts a unique bottom-up approach in which the family farmers, rather than scholars or practitioners, identify their actual legal needs. Derived from the Family Farm Legal Needs Survey conducted by the authors with the support of the Illinois Bar Foundation, this article fills a critical gap in the literature and will enable …
Hedging To Safety: A Political Economy Of Derivatives, Risk And Agriculture In The Developing World, Sasha Coler Breger Bush
Hedging To Safety: A Political Economy Of Derivatives, Risk And Agriculture In The Developing World, Sasha Coler Breger Bush
Electronic Theses and Dissertations
It has become common for researchers and international development institutions to recommend the use of derivative instruments to developing country farmers and policymakers as a means of insuring agricultural incomes against the threats posed by volatile global commodity prices. Despite such enthusiasm, very little research to date examines whether or not derivative instruments actually can deliver income support to agricultural producers who face commodity price risk. This dissertation evaluates these recommendations, focusing upon the potential income security benefits of hedging with futures instruments for coffee farmers in Mexico, Brazil and Uganda during the 1998-2002 coffee crisis. The three-part quantitative and …
Migration, Development, And The Promise Of Cedaw For Rural Women, Lisa R. Pruitt
Migration, Development, And The Promise Of Cedaw For Rural Women, Lisa R. Pruitt
Michigan Journal of International Law
Part I of this Essay provides an overview of the rural-to-urban migration phenomenon, a trend the author calls the urban juggernaut. This Part includes a discussion of forces compelling the migration, and it also considers consequences for those who are left behind when their family members and neighbors migrate to cities. Part II explores women's roles in food production in the developing world, and it considers the extent to which international development efforts encourage or entail urbanization. Part III attends to the potential of human rights for this population, analyzing the Convention on the Elimination of All Forms of Discrimination …
Owning What You Eat: The Discourse Of Food, David N. Cassuto
Owning What You Eat: The Discourse Of Food, David N. Cassuto
Elisabeth Haub School of Law Faculty Publications
This essay examines the role of communication in the formation of law and social norms and the implications of that role for animal law and ethics. Part III contextualizes animal law within contemporary risk society. Part IV looks at how efficiency has transformed from an economic concept into a normative guideline and discusses how that transformation has affected animals and agriculture. It tracks the rise of industrial agriculture and ties it to this fundamental misunderstanding of the concept of efficiency. The essay concludes with some thoughts on how to reformulate contemporary notions of efficiency and ethics to account for the …
Towards A Greenhouse Gas Labeling Regime For Food, Travis Annatoyn
Towards A Greenhouse Gas Labeling Regime For Food, Travis Annatoyn
Sabin Center for Climate Change Law
This paper proposes that the federal government implement greenhouse gas labeling standards for food and food products sold within the United States. A labeling regime of this sort would shift consumer purchasing from “high emission” to “low emission” foods and encourage consumer awareness that food, like any other commodity, has a GHG “price.”

Is Nafta A Good Model For China?: Lessons From Mexico And The United States, Carmen G. Gonzalez

In response to skyrocketing food prices, the global financial crisis, and the degradation of farm lands due to urbanization and industrialization, China has placed rural development at the top of its political agenda. China’s renewed emphasis on rural development is taking place against a backdrop of global efforts to reduce trade barriers in the agricultural sector. This article uses the North American Free Trade Agreement (NAFTA) as a case study on the complex ways that trade policy affects domestic efforts to protect the environment and promote rural development. The objective is to draw lessons from the experiences of the United …
