The United States has always been a nation of immigrants, in which the idea of “citizenship” has had very strong intrinsic values, and has divided those who “have it” from those who “don’t,” since the first legal construction of such categories in 1790. Longstanding contradictions, characterized by ceremonies awarding citizenship to some and laws of exclusion, deportation, and forced removal for others, have embodied U.S. approaches to citizenship, and created a dichotomy between “citizen” and “alien.” This Master's Thesis will initiate a discussion and reformulation of what it means to be a citizen in the United States, and more importantly …

Jurors' Ability To Judge The Reliability Of Confessions And Denials: Effects Of Camera Perspective During Interrogation, Lindsey Nicole Sweeney

Previous research shows that some proportion of people interrogated confess, regardless of actual guilt. It has also been shown that the camera perspective from which an interrogation is videotaped influences later judgments of voluntariness and guilt, as well as sentencing recommendations. The present research extends the understanding of this phenomenon of false confessions and the camera perspective bias. Ecologically valid videotaped true/false confessions and denials were obtained in Experiment 1. The proportions of guilt participants and participants that confessed to cheating were found to be smaller in Experiment 1 than those in previous research. Participants in Experiment 2 viewed the …

The domain of legal epistemology is defined from two alternative perspectives: individual epistemology and Social epistemology. Since these perspectives have different objects of evaluation, their judgments privilege and exclude different sets of information. While methodological individualism is concerned with justified beliefs of individual knowers, the Social angle focuses on the institutional conditions of knowledge. I will show that the information that is respectively excluded by both the individual and the Social concepts of legal epistemology weaken their respective evaluations. The regulations are known as the Federal Policy for the Protection of Human Subjects, and often referred to as the "Common Rule" because 18 Federal agencies follow some form of the policy. The purpose of this study is to better understand the attitudes towards wrongful convictions and levels of punitiveness among college students who may work in the criminal justice field in the future. It attempts to replicate Robert Ramsey and James Frank's 2007 study "Wrongful Conviction - Perceptions of Criminal Justice Professionals Regarding the Frequency of Wrongful Conviction and the Extent of System Errors." Instead of surveying criminal justice professionals, this study's sample is on-campus undergraduate classes in criminal justice and political science for the spring 2010 semester at Old Dominion University using a survey that operationalizes punitiveness with a series …

As the courts have evolved over the past 30 years towards increasingly punitive sanctions for youthful offenders, the fundamental protections afforded to adult defendants have become increasingly relevant for youthful offenders. Among these protections, the right of juveniles to be competent to stand trial has gained nearly universal recognition throughout this country’s courts. Congruent with theory and previous research, we hypothesized that age, intellectual ability, psychiatric symptomatology, and maturity would all be directly related to adolescents’ competence. The City of New London, allowed a local government to utilize eminent domain to transfer land from one private entity to another in order to enhance economic development. The current sociopolitical context in this state frames access to civil legal services either through a means-tested (and underfunded) program (Civil Legal Assistance) or as a privately purchased market service. This paper is an examination of the case Chevron v. Natural Resources Defense Council (1984). Using cases from the U.S. Ninth District Circuit Courts, from the years 2008 and 2009,1 examine how this case is being used today. Both behavioral models and models made explicitly to study the use of Chevron were used in order to determine not only how a judge cites this case but also whether their political orientation plays a role.
