Torture After Nuremburg: Us Law And Practice, Elizabeth Rapaport Nov 2009

Torture After Nuremburg: Us Law And Practice, Elizabeth Rapaport

Faculty Book Display Case

In this essay I will argue that the signature methods of interrogation used by CIA and military interrogators in the Global War on Terrorism (GWOT) -- torture lite' techniques such as hypothermia and stress positions -- may constitute torture, but that the question of their legality under U.S, and international law is not as straightforward as some critics of the Bush Administration maintained. I will take up only one thread in the complex discussion of GWOT interrogation practices and law, that of the boundary between torture and lesser cruelty.

Handbook For Promoting Foreign Direct Investment In Medium-Size, Low-Budget Cities In Emerging Markets, Vale Columbia Center On Sustainable International Investment, Millennium Cities Initiative

Columbia Center on Sustainable Investment Books

In November 2009, the Vale Columbia Center on Sustainable International Investment and the Millennium Cities Initiative (MCI) released the Handbook for Promoting Foreign Direct Investment in Medium-size, Low-Budget Cities in Emerging Markets. With foreign direct investment (FDI) flows declining worldwide by an estimated 40-50% this year (following a decline of over 10% in 2008), investment promotion has become more important than ever: in a highly competitive world FDI market, promotion can make all the difference.

Investment promotion is particularly important for cities other than capital cities, as investors in manufacturing and services often locate primarily in a country’s capital …

Relationship Banker : Eugene W. Stetson, Wall Street, And American Business, 1916-1959, James L. Hunt

Books and Chapters

In 1916, Eugene W. Stetson, a thirty-five year old banker from Macon, Georgia, became a vice-president with the Guaranty Trust Company of New York, a 'Morgan Bank'. Although by this time Pierpont Morgan was dead, Guaranty still resided fully within the Morgan firm's orbit, its broader policies controlled by the votes of Morgan partners. Stetson took full advantage of the Guaranty-Morgan opportunity. Between 1916 and his death in 1959, he became president and chairman of Guaranty. He survived the booms and busts of World War I and its aftermath, the stock-crazed 1920s, the transformation of banking in the Depression, and …

Playing Politics At The Bench: A White Paper On The Justice Department's Investigation Into The Hiring Practices Of Immigration Judges, Penn State Law Immigrants' Rights Clinic, National Immigration Project Of The National Lawyers Guild

Center for Immigrants' Rights Clinic Publications

On behalf of the National Lawyers Guild National Immigration Project (NLGNIP), the Center for Immigrants' Rights (Center) at the Pennsylvania State University's Dickinson School of Law prepared a white paper facilitated by a government report on the politicized hiring of immigration judges. This white paper is based findings by the Department of Justice‘s Office of Professional Responsibility and Office of the Inspector General in their investigation of the illegal hiring of immigration judges during a period in the George W. Bush Administration. The recommendations presented here are a product of this analysis and extensive research on data produced by individuals …

From Paradox To Subsidiarity: The United States And Human Rights Treaty Bodies, Tara J. Melish

Contributions to Books

Published as Chapter 8 in The Sword and the Scales: The United States and International Courts and Tribunals, Cesare P.R. Romano, ed.

It is frequently said that the United States has a paradoxical human rights policy. This Article takes a closer look at this vision from the perspective of U.S. engagement with international human rights treaty bodies, the quasi-adjudicatory expert committees or commissions that exercise supervisory jurisdiction over the U.S. human rights record. Contrary to popular perception that the U.S. thumbs its nose at these bodies, the U.S. in fact engages quite actively with their human rights procedures.

Suffrage And The Terms Of Labor, Robert J. Steinfeld Aug 2009

Suffrage And The Terms Of Labor, Robert J. Steinfeld

Contributions to Books

Published as Chapter 9 in Human Capital and Institutions: A Long Run View, David Eltis, Frank D. Lewis & Kenneth L. Sokoloff, eds.

Great books often harbor deep tensions, which are one source of their enduring power. Time on the Cross by Robert Fogel and Stanley Engerman is a good example (Fogel and Engerman 1974). On the one hand, Time on the Cross argued that the economic science of Cliometrics was indispensable for a proper understanding of the past. Human beings have always been primarily motivated by the desire for gain, and to understand their behavior it is essential to …
