The Permissibility Of Comment On The Defendant's Failure To Testify In His Own Behalf In Criminal Proceedings, Leslie H. Dills

When the question as to whether or not a prosecuting attorney should be permitted to comment on the failure of the accused in a criminal action to testify in his own behalf first arose in the state of Washington, the Supreme Court rested its decision denying the right to make such comment on a statute. The abrogation of this statute by the Supreme Court under its rule-making power, leaves this question of vital importance in criminal practice open and undecided in this State.

Admissibility In Federal Courts Of Evidence Wrongfully Obtained By Persons Other Than Federal Officers Or By Cooperation Between Such Persons And Federal Officers, Marion A. Marquis

It is a firmly established rule in the federal courts, that evidence obtained by an illegal search and seizure, within the purview of the Fourth Amendment to the Constitution of the United States, is not admissible providing timely steps are taken for its exclusion or return. However, that rule is limited in its application to federal officers or agents, so that quite generally it may be said, that evidence obtained by private,mdividuals or municipal or state officers, acting as such, is admissible in federal courts, regardless of the manner in which it is obtained.

The American Bar Association is a voluntary association, organized at Saratoga, New York, in 1878. The object of the Association, as defined by its Constitution, is "to advance the science of jurisprudence, promote the administration of justice and uniformity of legislation and of judicial decision throughout the Nation, uphold the honor of the profession of the law, and encourage cordial intercourse among the members of the American Bar." The Association has at present about 28,000 members, residing throughout all of the United States proper and in Hawaii, China, Porto Rico and the Philippine Islands.
