This report summarizes the historical and legal precedents respecting the power of the House of Representatives to expel one of its Members. There exists no constitutional provision, federal statute, House rule, or precedent which is totally dispositive of the issue. Instances in which the House has expelled Members number three, all occuring in the 37th Congress.

Although the Supreme Court had applied the Fourth Amendment to state administrative searchesi involving municipal fire, health and housing inspection programs, the Court's position as to the applicability of the Fourth Amendment to federal administrative codes and procedures was unclear. The Supreme Court settled that question in Marshall u. Barlow's Inc., 436 U.S. 307 (1978).

The Supreme Court in Duran u. Missouri, 99 S.Ct. 664 (1979) overturned a Missouri defendant's first degree murder conviction in holding that a "systematic exclusion of women [which] results in jury venires averaging less than 15% females violates the Constitution's fair cross-section requirement." 99 S.Ct. at 666. The decision, delivered by Justice White, represents a further progression in the Whitus to Castendal line of cases establishing and defining the meaning of a fair trial under the Sixth and Fourteenth Amendments.

Regressive Hypnosis And The Polygraph: A Case Study, Charles B. Mutter M.D.

This presentation deals with the examination of a female witness and possible suspect involved in a double murder. A polygraph apparatus was attached to the subject during a hypnotic regression. An ideomotor response signal equivalent to a polygraph type response was also utilized. The findings were significant psychodynamically and may explain why reliability of such procedures is deemed questionable.

An aura of the occult surrounds the mention of hypnosis. As a result, hypnotism is rarely used in court. Although tainted by its sideshow reputation, hypnosis, when applied properly, can substantially aid both the investigation and litigation stages of law enforcement.

Hypnosis and the law have a rather tedious history. Courts all over the country consistently have held inadmissible statements of a defendant, made out of court, while under hypnosis. The rationale is not too difficult to comprehend. Critics of hypnosis as an investigative tool belittle its reliability. They will present cases in which evidence gained through hypnosis turned out to be unreliable. This reluctance to acceptance still may be fostered by antiquated notions. In short, hypnosis was once looked upon as a kind of vaudeville gag, or worse, as a demonic device to control a person's mind. And while reliability …

Affirming An Illegitimate Statute, Ron Byrd

On December 11, 1978, the Supreme Court in a 5-4 decision, upheld the constitutionality of a statute allowing an illegitimate child to inherit from his intestate father only if a court of competent jurisdiction has, during the father's lifetime, entered an order declaring paternity. In Lalli v. Lalli, 99 S.Ct. 518 (1978) the Court stated that the proof requirement imposed by the New York statute on illegitimate children who would inherit from their father, was not in violation of the Equal Protection Clause of the 14th amendment.
