Impact Of The Delegation Doctrine On Prison Privatization, Ira Robbins
Impact Of The Delegation Doctrine On Prison Privatization, Ira Robbins
Articles in Law Reviews & Other Academic Journals
Few people would argue that the state of our nation's prisons and jails is ideal. Apart from whatever other ills plague these institutions, overcrowding is pervasive. Populations have doubled in a decade, and with preventive detention, mandatory minimum sentences, habitual offender statutes, and the abolition of parole in some jurisdictions, there is no relief in sight. Some states are even leasing or purchasing prison space in other states. And it is costing the taxpayers more than seventeen million dollars a day to operate the facilities, with estimates ranging up to sixty dollars a day per inmate.

Privatization Of Prisons: An Analysis Of The State Action Requirement Of The Fourteenth Amendment And 42 U.S.C. § 1983, Ira Robbins
Articles in Law Reviews & Other Academic Journals
Introduction: The privatization of prisons raises important issues with respect to liability in suits brought by inmates. If a private company operates the prison, the state likely will be directly involved in some aspects of prison life, such as using force when necessary or making quasi-judicial decisions, but it may not be directly involved in the day-to-day operation of the institution. This dichotomy of involvement may lead to con- fusion over responsibility and accountability when a violation of rights is alleged to have occurred. When a private party, as opposed to a government employee, is charged with abridging rights guaranteed …
Estimating The Residual Demand Curve Facing A Single Firm, Jonathan Baker, Timothy Bresnahan
Estimating The Residual Demand Curve Facing A Single Firm, Jonathan Baker, Timothy Bresnahan
Articles in Law Reviews & Other Academic Journals
This paper presents an econometric technique for estimating the single firm residual demand curve that does not require the estimation of demand cross-elasticities. The technique is particularly suited for the estimation of firm market power in product differentiated industries, where cross-elasticities are notoriously difficult to measure. One estimated parameter is directly related to a firm's markup of price over marginal cost when product differentiation is extensive, when an industry consists of a dominant firm and a price-taking fringe, when a Consistent Conjectures Equilibrium is the correct oligopoly solution concept, when firms are Stackelberg leaders relative to their environment, or when …

Lawyers And The Rule Of Law In The Western Hemisphere, Claudio Grossman, Frederick Anderson
Articles in Law Reviews & Other Academic Journals
Relations between the United States and Latin America are once again entering a historic phase. How the nations of the Americas handle issues such as the rule of law and the role of judges and lawyers in human rights, trade, immigration, narcotics traffic, security, and natural resources development will shape the future of nations in this hemisphere. Because all of these issues have strong legal content, attorneys in the United States and Latin America have a particular responsibility to address them cooperatively.A history of conflict between north and south, widely varying intellectual and cultural traditions, and numerous differences between Anglo-American …

Who Cares Who Wrote "Shakespeare"?, Peter Jaszi
Articles in Law Reviews & Other Academic Journals
Obviously, a great many people, on both (or all) sides of the "authorship question," and they care a lot. The real question is why. Proponents of various authorship claimants compete in their protestations of admiration for the plays and poems in controversy. But if these works are in fact so universally and inexhaustibly fertile of significance, why should any admirer of them waste precious time, which might better be devoted to the study of the texts themselves, arguing about an ultimately irresoluble historical puzzle? And why is so much of the discussion conducted at such a relatively high pitch of …
