Science, Common Sense, And Criminal Law Reform, Jerome Hall

Professor Hall advocates a reappraisal of the current trend in criminal law of substituting expert psychiatric testimony for common-sense determinations of insanity based on the long experience of the criminal-law tradition. Holding that the average layman is as competent to recognize extreme mental illness as the psychiatric expert, the author discusses the doctrine of the "irresistible impulse" and submits that the current departures from the M'Naghten rule tend to "substitute the ideology of a particular group of psychiatrists for the principle of moral responsibility." The Use Of Public Opinion Polls In Continuance And Venue Hearings, Edward F. Sherman

Courts are becoming increasingly receptive to the admission of the results of public opinion polls to show community attitudes and prejudgments as to certain criminal cases in which continuances or changes of venue are sought by the defendants. Mr. Sherman concludes that polls may provide a degree of evidentiary certainty now lacking, but he warns that polls can also be tricky unless properly conducted and interpreted.

After a detailed examination of the unique position of the emerging nations, the "third 'world," Professor Fatouros urges that the Western nations should ndertake a change in approach and a reassessment of the objectives of international law since the present situation of international society is so dissimilar to that in which the law evolved. He concludes that special, new rules should be formulated, based on a broad and positive consideration of the urgent need of the emerging nations to develop their natural resources as effectively and as rapidly as possible-a need 'which international law must take into account if it …

In this article Professor Dickerson examines some of the most basic problems facing the legislative draftsman in his attempt to obtain clarity in statutes. He discusses the "diseases" of ambiguity, over-vagueness, over-precision, over- and under-generality and obesity, and distinguishes them from useful devices with which they are often confused.
