Since 2012, the “Open Researcher and Contributor ID” organisation (ORCID) has been successfully running a worldwide registry, with the aim of “providing a unique, persistent identifier for individuals to use as they engage in research, scholarship, and innovation activities”. Any service in the scholarly communication ecosystem (e.g., publishers, repositories, CRIS systems, etc.) can contribute to a non-ambiguous scholarly record by including, during metadata deposition, referrals to iDs in the ORCID registry.

The OpenAIRE Research Graph is a scholarly knowledge graph that aggregates both records from the ORCID registry and publication records with ORCID referrals from publishers and repositories worldwide to …

Revisiting The Tri-Partite Relationship Between An Insurance Carrier, A Policyholder, And An Insurance Defense Attorney, Ross Pesek, Alejandra Ayotitla Cortez Nov 2021

Revisiting The Tri-Partite Relationship Between An Insurance Carrier, A Policyholder, And An Insurance Defense Attorney, Ross Pesek, Alejandra Ayotitla Cortez

Nebraska Law Bulletin (Selected Issues)

The tripartite relationship between the insured, insurer, and appointed defense counsel poses inherent conflicts of interest and ethical dilemmas. All parties are affected by the problems arising out of the relationship. The insured is in a vulnerable position when they are denied loyal representation and are threatened with financial ruin. Special attention must be placed on the insurer’s obligations to its insured, including completing a reasonable and proper investigation of the claim, providing a defense if the potential for liability exists, timely effecting a reasonable settlement, and giving equal consideration to the insured’s interest.

On the defense counsel’s side, the …

Issue Of False Amphetamine Field Test Positives Caused By Sugar. Use Of Baeyer Test As A Secondary Test Solution., Reed A. Knutson, Jennah Duncan, Kara Peightal, Samuel Thomas

Department of Chemistry: Dissertations, Theses, and Student Research

The Marquis reagent is a well-established and widely used chemical presumptive test for 3,4-Methylenedioxymethamphetamine (MDMA) and methamphetamine. It is composed of concentrated sulfuric acid and 40% formaldehyde, which act upon alkaloids causing them to complex into larger molecules. This complexation causes a color change that can be visually interpreted as a positive or negative result. Almost any sugar molecule can be complexed in this way as well, due to their many OH groups. Experimentally it was found that the sugar molecules did complex with one another when the Marquis test was administered. The color produced by this reaction was brownish-red. …

Truth and Reconciliation History Project

A bibliography of resources about the history in Nebraska of Native Americans, African Americans, Latinos, Asian Americans and Recent Refugees

We hope that these five bibliographies will prove fruitful in helping us to understand what our history has been, where we have gone astray, and what we can do to help bring about reconciliation in our community and in our state.

The discovery of what has happened in Nebraska in the last hundred and seventy years is not an easy task, but it is our goal in putting together this bibliography to begin that task. By putting together a picture …

Copyright, Fair Use, Scholarly Communication, etc.

Research information management (RIM) is a rapidly growing area of investment in US research universities. RIM systems that support the collection and use of research outputs metadata have been in place for many years. Globally, the RIM ecosystem is quite mature in locales where national research assessment exercises like the United Kingdom’s Research Excellence Framework (REF) and the Excellence in Research for Australia (ERA) require institutions to collect and report on the outputs of institutional research. A pan-European community of practice is led by euroCRIS.

This report describes six discrete RIM use cases detailed in the companion report:

A Survey Of Researchers’ Needs And Priorities For Data Sharing, Iain Hrynaszkiewicz, James Harney, Lauren Cadwallader Oct 2021

A Survey Of Researchers’ Needs And Priorities For Data Sharing, Iain Hrynaszkiewicz, James Harney, Lauren Cadwallader

Copyright, Fair Use, Scholarly Communication, etc.

One of the ways in which the publisher PLOS supports open science is via a stringent data availability policy established in 2014. Despite this policy, and more data sharing policies being introduced by other organizations, best practices for data sharing are adopted by a minority of researchers in their publications. Problems with effective research data sharing persist and these problems have been quantified by previous research as a lack of time, resources, incentives, and/or skills to share data.

In this study we built on this research by investigating the importance of tasks associated with data sharing, and researchers’ satisfaction with …

Addressing The Harms Of Pornography, Gillian Allison Oct 2021

Addressing The Harms Of Pornography, Gillian Allison

Honors Theses

Within this paper I look at the existing philosophical work on pornography, from scholars like Catherine MacKinnon, Ronald Dworkin, and Rae Langton to show the current state of the pornography debate that I intend to enter by presenting my own argument about the morality of pornography. I argue that while pornography is harmful, these harms are best resolved through increased sexual education and the popularization and production of more inclusive pornography. The harms pornography causes are so great because pornography is where a lot of people learn about sex. Pornography was never designed to depict an average sexual experience. If …

The Nuances Of “Tag-Gag” Laws, Jareb Gleckel Sep 2021

The Nuances Of “Tag-Gag” Laws, Jareb Gleckel

Nebraska Law Bulletin (Selected Issues)

This Essay addresses what I have elsewhere called “Tag-Gag” Laws—laws that regulate and restrict how companies can label and advertise plant-based meat products. Plant-based meat is food made entirely from plants that replicates the taste and texture of animal meat. As plant-based meat sales have grown exponentially in recent years, increasing numbers of states have passed Tag-Gag laws; companies selling plant-based meat, in turn, have challenged these laws in court. When covering these lawsuits, the media often (and understandably) lumps them altogether. If a plant-based company wins a preliminary injunction against a state law, it is viewed as a victory …

A Nation And Culture's Fight For Survival: How The Existing Indian Family Exception Renders Icwa Inapplicable, Keely Kleven Aug 2021

A Nation And Culture's Fight For Survival: How The Existing Indian Family Exception Renders Icwa Inapplicable, Keely Kleven

Nebraska Law Bulletin (Selected Issues)

The Indian Child Welfare Act (ICWA) was enacted to curtail the removal of Indian children from their tribes and families by allowing tribes to have jurisdiction over custody proceedings involving Indian children; it ensured the security of tribes by allowing them to pass Indian culture down from one generation to the next. The chances of Indian survival, as noted by Calvin Isaac, are significantly reduced when Indian children are raised in non-Indian homes or denied exposure to their heritage. Although some states have complied with the spirit of the ICWA, other states have created the existing Indian family (EIF) exception …

Copyright And State Sovereign Immunity: A Report Of The Register Of Copyrights, Shira Perlmutter Aug 2021

Copyright And State Sovereign Immunity: A Report Of The Register Of Copyrights, Shira Perlmutter

Copyright, Fair Use, Scholarly Communication, etc.

In March 2020, the Supreme Court held in Allen v. Cooper that Congress had exceeded its constitutional authority when it enacted legislation authorizing copyright infringement suits for damages against states.1 The Court based its decision on the legal doctrine of sovereign immunity, which generally precludes a federal court from hearing a suit against a state without the state’s consent. The Court noted that Congress has the power to abrogate state immunity, including to prevent or remedy deprivations of property without due process in violation of the Constitution. To do so, however, Congress generally must develop a legislative record demonstrating a …

The Nebraska Criminal Law Practitioner's Guide To Representing Non-Citizens In State Court Proceedings: July 2021, Kevin Ruser

The Nebraska Criminal Law Practitioner's Guide to Representing Non-Citizens in State Court Proceedings

The goals of this Guide are to give Nebraska criminal law practitioners and judges an overview of the federal immigration system, acquaint them with immigration issues that may arise as the result of state criminal proceedings, and analyze various Nebraska criminal statutes in terms of their potential immigration consequences.

This Guide was last significantly updated in 2012 – nine years ago. In 2012, I wrote about how many developments there had been in the “crimmigration” field since the 2010 update to this Guide. Those developments pale in comparison to the developments that have occurred since 2012, however, both in terms …

What’S The Big Deal? How Researchers Are Navigating Changes To Journal Access, Danielle Cooper, Oya Y. Rieger Jun 2021

What’S The Big Deal? How Researchers Are Navigating Changes To Journal Access, Danielle Cooper, Oya Y. Rieger

Copyright, Fair Use, Scholarly Communication, etc.

The dominant mode by which research libraries have provided maximum journal access as cheaply as possible—subscription bundles or “Big Deals”—is giving way to new approaches. This transition is taking place through a combination of negotiations, activism, business modeling, user needs research, and decision support, among other factors. To support these processes, Ithaka S+R partnered with 11 academic libraries to understand researcher perceptions to help inform their ongoing strategic decision making about Big Deal journal subscriptions.

Recognizing that libraries must also undertake case-by-case assessments prior to making decisions about any particular journal package, in this report we share findings from the …

A Balancing Act: Public Health, Covid-19, And The Economic Due Process “Right To Work”, Jennifer L. Piatt Jun 2021

A Balancing Act: Public Health, Covid-19, And The Economic Due Process “Right To Work”, Jennifer L. Piatt

Nebraska Law Bulletin (Selected Issues)

During the infamous Lochner era (1897–1937), courts invalidated hundreds of regulatory measures on economic liberty grounds, doing untold damage to public health. Two vehicles have recently emerged by which the Supreme Court could re-enter this long-dead line of “economic due process” jurisprudence: first, via challenges to particularly burdensome professional licensing requirements; and second, via challenges to business closure orders resulting from the COVID-19 pandemic. This article concludes that the Supreme Court’s re‑entry into the “right to work” conversation, albeit unlikely, could help prevent certain unduly burdensome licensing requirements from surviving simply on protectionist grounds. Nonetheless, to protect the public’s health, …

Swissenveo: A Fair National Environmental Data Repository For Earth Observation Open Science, Gregory Giuliani, Hugues Cazeaux, Pierre-Yves Burgi, Charlotte Poussin, Jean-Philippe Richard, Bruno Chatenoux

Copyright, Fair Use, Scholarly Communication, etc.

Environmental scientific research is highly becoming data-driven and dependent on high performance computing infrastructures to process ever increasing large volume and diverse data sets. Consequently, there is a growing recognition of the need to share data, methods, algorithms, and infrastructure to make scientific research more effective, efficient, open, transparent, reproducible, accessible, and usable by different users.

However, Earth Observations (EO) Open Science is still undervalued, and different challenges remains to achieve the vision of transforming EO data into actionable knowledge by lowering the entry barrier to massive-use Big Earth Data analysis and derived information products. Currently, FAIR-compliant digital repositories cannot …
