Books And Olive Oil: Why Antitrust Must Deal With Consolidated Corporate Power, Carl T. Bogus

Following an epic battle in the marketplace between Apple and major book publishers, on one side, and Amazon, on the other side, the United States Department of Justice and thirty-three states filed an antitrust lawsuit against Apple and the publishers, alleging that they had conspired to fix the prices of ebooks. Both the district court and a divided panel of the United States Court of Appeals for the Second Circuit decided the case in the government’s favor. Methodological Issues In The Content Analysis Of Pornography, Daniel Linz, Edward Donnerstein

No scientifically sound analysis of the content of pornography in the United States as a whole currently exists. Dietz and Sears's article takes us a small step closer to quantifying the contents of pornography. Some of the methods employed in the present study, however, prohibit us from making solid generalizations from the findings reported here to the nationwide pornographic marketplace. Our critique of the article will concentrate first on the methods employed in the study and then on the findings obtained through these methods and the authors' interpretation of these findings.

During the eighteen months that the Attorney General's Commission on Pornography (the Commission) conducted public hearings, public discussion, and staff research, one of the most common types of inquiry directed to the staff consisted of questions as to the content of pornography currently available in the United States. Part II addresses the case law on university photocopying, both prior to and following the adoption of the Act. Part III briefly discusses the policies underlying university photocopying. The Note concludes with an analysis of the NYU settlement in relation to copyright law.
