Ecotypes And Killer Whales: A Scientific Concept To Guide The Endangered Species Act's "Distinct Population Segment", Christopher Michael Johnson

The Endangered Species Act protects threatened and endangered species, subspecies, and distinct population segments, with species listings guided by the best scientific information available. "Distinct population segment," however, is not a biological term. To date, there is still not a test based on evolutionary theory used to determine distinct population segments. This Comment attempts to change that by introducing the ecotype concept-a scientific theory that has existed for over one hundred years-into jurisprudence. This Comment begins by recounting how the distinct population segment terminology came to be. Next, it argues that the Endangered Species Act has been implemented contrary to …

The Center’s 29th annual conference will focus on the changes in the West resulting from rapid population growth, development, disrupted historical weather patterns and the effects of those changes on land, water, and energy resources. Viewed from a watershed perspective, we are unconsciously sacrificing many marine ecosystems because upstream fresh water is a regulatorily fragmented resource. That is, water is subject to multiple assertions of regulatory authority and to multiple types of use-right claims that those authorities regulate. As freshwater supplies become increasingly unequal to the task of meeting the multiple demands for both consumptive and in situ use, and as consumptive and in situ uses of water come increasingly into irreconcilable conflict, the various regulatory schemes governing water use have also increasingly come into legal conflict. After Gonzales V. Raich: Is The Endangered Species Act Constitutional Under The Commerce Clause, Bradford C. Mank

In both its 1995 decision United States v. Lopez and in its 2000 decision United States v. Morrison, the Supreme Court had adopted a narrow economic interpretation of congressional authority to regulate intrastate activities under the Commerce Clause. In four separate cases, three circuit courts (the District of Columbia, Fourth, and Fifth Circuits) struggled with deciding whether Congress may still protect endangered and threatened species that have little commercial value under the Commerce Clause after Lopez and Morrison.
