Hip-Hop And Housing: Revisiting Culture, Urban Space, Power, And Law, Lisa T. Alexander

U.S. housing law is finally receiving its due attention. Scholars and practitioners are focused primarily on the subprime mortgage and foreclosure crises. Yet the current recession has also resurrected the debate about the efficacy of place-based lawmaking. Place-based laws direct economic resources to low-income neighborhoods to help existing residents remain in place and to improve those areas. Law-and-economists and staunch integrationists attack place-based lawmaking on economic and social grounds. This Article examines the efficacy of place-based lawmaking through the underutilized prism of culture. Using a sociolegal approach, it develops a theory of cultural collective efficacy as a justification for place-based …

Environmental protection and economic concerns are not mutually exclusive. This article explores some of the issues of economic analysis that might arise as we approach the fourth generation of environmental law. It explains ways that economic analysis can be employed to generate the best environmental rules, including measures under what this article terms as "economics-based environmentalism." Economics-based environmentalism contends that the advantages of using economic principles within a “polycentric toolbox” of environmental law come from the benefits available in private ordering, markets, property rights, liability regimes and incentives structures that will better protect the environment than alternatives like state-based interventionist, …

Auch wenn der Fortschritt von law and economics in einigen Zivilrechtsländern von Zeit zu Zeit anerkannt wird, besteht die herkömmliche Auffassung noch immer darin, dass die Rechtsberufe auf zivilrechtlichen Gebieten für ökonomische Argumentationen unzugänglich sind. Zumindest für Brasilien ist jedoch die Annahme der Isolierung der Rechtspraxis von ökonomischer Argumentation schlechthin falsch. Der zunehmende Einsatz ökonomischer Argumentation an den brasilianischen Gerichten keine Folge blinder Nachahmung ausländischer Modeströmungen ist. Muito se pode aprimorar a aplicação do direito falimentar quando se conhece a lógica econômica de suas regras e princípios. Esse texto examina separadamente a racionalidade econômica de quatro aspectos centrais da LRF, a saber: (i) o princípio da universalidade da falência, (ii) o conceito de insolvência empresarial como predominantemente ligado à falta de caixa (e não à existência de déficit patrimonial), (iii) a responsabilização de sócios e administradores pelo agravamento de crises econômico-financeiras de empresas, e (iv) o processo de realização do ativo de empresas insolventes.

This Article is a first-of-its-kind application of public choice theory to recently developing theories of virtue jurisprudence. Particularly, this Article focuses on not-yet-developed theories of aretaic (or virtue-centered) legislation. This Article speculates what the contours of such theories might be and analyzes the production of such legislation through a public choice lens. This Article provides a financial economic theory of punitive damages. The core problem, as the Supreme Court acknowledged in Exxon Shipping Co. v. Baker, is not the systemic amount of punitive damages in the tort system; rather, it is the risk of outlier outcomes. Low frequency, high severity awards are unpredictable, cause financial distress, and beget social cost. By focusing only on offsetting escaped liability, the standard law and economics theory fails to account for the core problem of variance. Trata-se de uma contextualização da Análise Econômica do Direito – AED dentro da epistemologia jurídica em um contexto civilista. A partir de uma revisão dos paradigmas dominantes no direito brasileiro, contextualiza-se histórica e epistemologicamente a abordagem da AED. O objetivo é oferecer uma primeira abordagem por juristas e economistas, ressaltando algumas utilidades e limitações para ambos os campos.
