There has been a huge surge in writing about happiness and law. Part of the rationale for the interest in happiness is that it is a potential substitute for conventional notions of efficiency. Every conventional efficiency-oriented standard is based on expectations that one will be better off. For example, demand is based on willingness to pay but not on the outcome of the actual purchase.
