Human Trafficking And Slavery Reconsidered. Conceptual Limits And States' Positive Obligations, Vladislava Stoyanova
Human Trafficking And Slavery Reconsidered. Conceptual Limits And States' Positive Obligations, Vladislava Stoyanova
Vladislava Stoyanova
By reconsidering the international law definitions of human trafficking, slavery, servitude and forced labour, the book demonstrates that in embracing the human trafficking legal framework the international community side-lined the human rights commitments against slavery, servitude and forced labour that in many respects provide better protection for abused migrants. This development urgently requires a reversal and the book proposes two corrective steps. The first is placing a renewed emphasis on the human rights law concepts of slavery, servitude or forced labour, and on determining their definitional scope. The second entails a clearer understanding of states’ positive human rights obligations corresponding …

Summary:
Among the environmental challenges, which humanity is facing today, there are the threat of global climate change, unsatisfactory air quality, – especially in large cities, – and the fact that the resources of fossil fuels are finite. Biofuels have long been at the top of the political and scientific agenda as a possible solution to all the three challenges.
Not everything is clear about biofuels. The production costs of biofuels are still higher than those of traditional fossil fuels: without subsidies biofuels are not competitive. The environmental impact of biofuels has also been questioned, for example the …

The Extraterritoriality Of Eu Data Privacy Law - Its Theoretical Justification And Its Practical Effect On U.S. Businesses, Dan Jerker B. Svantesson
Dan Svantesson
Due to its extraterritorial effect, the European Union’s trailblazing data privacy law has long been a major concern for U.S. businesses. With the proposal for a new data privacy framework in the EU, with potential penalties of up to 2% of an offending enterprise’s annual worldwide turnover, such concerns are justified indeed; particularly as the EU at the same time seems to be expanding the extraterritorial reach of its data privacy law.
This article examines the extraterritoriality of current and proposed EU data privacy law and analyses whether those claims of extraterritoriality can be either justified or objected to by …

Using Sustainability Criteria For Biofuels In A Legal Context - An Analysis Based On The Eu Policy For Transport Biofuels, Evgenia Pavlovskaia

Sustainable quality of biofuels and their production methods should be seen as a part of the wider concept “sustainability”. Sustainability of biofuels should be measured in relation to resources and possibilities that the Earth can supply us with. This presentation focuses on sustainability criteria in their function to promote sustainability in a legal context, followed by the analysis of the binding EU regulations for transport biofuels as an example. Two main issues are examined: - the concept of sustainability criteria, special features of their use in law and aspects relevant for their practical implementation, and - the issue of control …

This dissertation deals with the position of working parents in labour legislation and the protection. The starting point for the thesis is that the rules in labour law concerning employees? parenthood, despite the fairly strongly formulated protection of their rights, in practice have a relatively weak normative position in working life and in labour law. The weakness of the rules on parenthood can be explained as a result of a normative conflict, or incoherence, affecting the judicial sphere, which means that deviating norms and values encroach on the rules about parenthood and weaken their position. The central aim of the …
