This paper reflects upon approaches to procedural governance in (transnational) criminal investigation.The structure and strategies adopted in England and Wales are contrasted with those in foreign jurisdictions with which investigation managers must become familiar if they are to conclude operations leading to successful prosecutions. Governance is a means of supporting and achieving such outcomes.

Transnational criminal investigations are being undertaken with increasing frequency. This is in part owing to the rising number of occasions in which any given domestic criminal investigation, particularly the investigation of serious crime involving the sourcing, transmission and distribution of illicit commodities, will encounter transnational criminal markets and so necessitate acquiring evidence from a foreign jurisdiction (Jones and Doobay 2005: 362). The Age of Information has taken investigative and intelligence capabilities beyond the imaginations of Age of Enlightenment philosophers such as John Locke whose social contract theory of governance remains the moral justification for policing. Through philosophical analysis taking as its starting point John Locke, and philosophers of policing such as John Kleinig and Seamus Miller, this essay reflects on the basis of first principles whether the social contract theory remains valid in a governance environment characterized by digital identity and control of identity data.
