Cal Law Trends and Developments

The most significant trend and development in workmen's compensation law in the past year has been the activity of the appellate courts in annulling and reversing the decisions of the Workmen's Compensation Appeals Board. With the Labor Code's severe limitations on the scope of judicial review of WCAB decisions, particularly on the right of the courts to review factual determinations, and with most of the WCAB cases containing factual rather than legal questions, the majority of petitions for writ of review have been and still are being denied.

Interpretation Of The Statutory Modification Of Joint And Several Liability: Resisting The Deconstruction Of Tort Reform, Gregory C. Sisk

Seattle University Law Review

This Article defends RCW 4.22.070 and opposes the deconstruction of legislative tort reform. The Article’s premise is that the legislature did indeed intend to accomplish a significant reform of the liability system and to take a long, purposeful stride toward the implementation of comparative fault as applied to all parties in tort litigation. The Article concludes that the legislature adopted language that adequately, if sometimes imperfectly, achieves that purpose. The Article discusses the following: the meaning of “fault” as applicable through RCW 4.22.070; the nature of the entities to whom fault must be allocated; the responsibility for raising the culpability …

Glass V. Stahl Specialty Company: Reconciling Third Party's Contribution Rights With Employer's Immunity Under Workers' Compensation, Karin Nyrop

Seattle University Law Review

This note argues that the correct resolution of the tension between the employer’s immunity and the third party’s right of contribution requires balancing the interests of all parties. The employer has an interest in retaining the workers’ compensation law’s exclusive no-fault recovery system; the third party tortfeasor seeks to avoid shouldering the entire liability of another at-fault tortfeasor capable of contribution. At the same time, the employee has a right to full and speedy compensation, and the state has an interest in maintaining the financial stability of its accident fund. Vanderbilt Law Review

The utilitarian and research value of radioisotopes, x-ray and fluoroscopic devices, cyclotrons and other particle accelerators, nuclear reactors, and other materials or devices emitting ionizing radiation is unquestioned. Ionizing radiation, however, can prove harmful as well as beneficial depending upon the care which is exercised in its use. Numerous cases of x-ray and radium injuries are reported in the literature, such injuries dating from 1896 when Roentgen first announced the discovery of x-rays. The most publicized cases of radiation injury are those occurring in the radium poisoning or "dial painters" cases in the 1920's. Unlike most noxious materials encountered in …
