Public Trust Protection For Stream Flows And Lake Levels, Ralph W. Johnson

The public trust doctrine and the appropriative water rights system are headed on a collision course in the West. Appropriators claim vested property rights to extract water for irrigation, mining, manufacturing and other uses. They further assert that under the appropriation doctrine such extractions can continue in perpetuity regardless of the consequences to navigation, fishery and other public values. The public, however, increasingly insists on more protection for environmental and ecological values, aesthetic quality and recreational opportunities, which on lakes and streams usually means leaving waters in place. Measuring Economic Impacts: The Application Of Input-Output Analysis To California Water Resources Problems, California Department Of Water Resources

In early 1976, the Department of Water Resources began developing a California input-output model for water resources management decisions aided by a federal grant from the Office of Water Research and Technology. This report presents the models and applications resulting from this jointly funded effort. While the study was in progress in early 1977, the economic consequences of the California drought became a subject of much concern. As a result, the Department used the model to make projections of the secondary economic impacts of the drought, an effort which proved useful in making difficult water management decisions.

The growing popularity of public boating and related water-based recreation is increasingly taxing the capacity of available lakes and strearns. As a result, accelerating demands have been made for public use of otherwise unavailable, "private" bodies of water. Although existing 'economic' and governmental mechanisms to expand recreational opportunities may be adequate in theory, they have failed to respond to these new demands coherently." This Article proposes that government enjoys additional power to increase the public's opportunity for water-based recreation.
The purpose of this Article is to lay a comprehensive, doctrinal foundation for broad governmental action. Simultaneously, this Article counsels a …
