The first statute giving a right of action for the death of a human being, Lord Campbell's Act was adopted in England in 1846. New York adopted a similar statute, a year later. At the present time all American jurisdictions have statutes conferring a right of action for wrongful death. These statutes differ widely in their terms, particularly as to the person authorized to bring the action, and as to those for whose benefit the action is prosecuted. The Status Of A Municipal Corporation Organized Under An Unconstitutional Statute, Oliver P. Field

A municipal corporation has governmental as well as proprietary functions to perform. It differs from a private corporation in that its primary functions are governmental. Municipal corporations are usually spoken of as legal persons, or entities, in the same sense that private corporations are, but in studying them it must always be borne in mind that the main purpose for which most of them are created is that they may perform certain governmental functions.
