Old Constitutions And New Issues: National Lessons From Vermont's State Constitutional Case On Marriage Of Same-Sex Couples, Robert F. Williams

Boston College Law Review

The Vermont Supreme Court's 1999 ruling in Baker v. State was a watershed decision, holding that same-sex couples in Vermont were entitled to the same benefits and protections as opposite-sex married couples. While Baker is extremely important as a matter of substantive law, and as a contribution to the national discussion of the issues surrounding marriage of same sex-couples, it also provides an excellent lens through which to consider principles of state constitutional law and the New Judicial Federalism. Baker V State And The Promise Of The New Judicial Federalism, Lawrence Friedman, Charles H. Baron

In Baker v. State, the Supreme Court of Vermont ruled that the state constitution's Common Benefits Clause prohibits the exclusion of same-sex couples from the benefits and protections of marriage. Baker has been praised by constitutional law scholars as a prototypical example of the New Judicial Federalism. The authors agree, asserting that the decision sets a standard for constitutional discourse by dint of the manner in which each of the opinions connects and responds to the others, pulls together arguments from other state and federal constitutional authorities, and provides a clear basis for subsequent development of constitutional principle.
