Beyond The New Federalism: Revenue Sharing In Perspective, George D. Brown

In 1972 Congress added General Revenue Sharing to the list of federal grant-in-aid programs for states and localities. President Nixon had recommended Revenue Sharing, as apart of his "New Federalism," because it would foster local autonomy by minimizing federal restrictions on the grants. When General Revenue Sharing was renewed in 1976, Congress made no changes in the formula, leading some commentators to minimize the significance of those changes which were made. Professor Brown argues that the 1976 renewal amendments to the Revenue Sharing Act are an example of "interventionist federalism," a new form of federal influence over state and local …

Juvenile Curfew Ordinances And The Constitution, Michigan Law Review

Recognizing that a legislature must decide whether to enact a juvenile curfew without the benefit of conclusive data on the effectiveness of such laws, the remainder of this Note will focus primarily upon the constitutional issues raised by such ordinances. The freedom of movement that is limited by a curfew is, it will be argued, an unenumerated right protected by the ninth and fourteenth amendments. The constitutional rights of juveniles, however, -are not necessarily coextensive with those of adults. Certain characteristics of juveniles-in particular, their lesser capacity for reason and self-control-imply that the strength of their right to freedom of …

Scholarly Works
The image of municipal power carries with it the accompanying concept of limitations on that power. One of the seemingly most natural of such limitations is that pertaining to territory. If a municipality is an incorporated entity, composed of precisely described physical boundaries, then its operational existence would normally be presumed to take place within those boundaries. The municipality's power to function outside its limits would thus appear not only unnecessary but foreign to the corporate conception. The problem with such neatness, of course, is its unworldliness. The truism is that neither man nor municipality is an island and that …

Establishment of James H. Quillen College of Medicine
Following the passage of the Teague-Cranston Act and Tennessee state legislation, with the Plan for Medical Education in place, the next step was qualifying for federal funds. With the help of U.S. Representative Jimmy Quillen and the State Board of Regents Chancellor Roy Nicks, the application for funds was approved by the Veterans Administration on July 11, 1974. However, it was not until Dr. Culp's last day in office as President of ETSU, that the Liason Committee on Medical Education issued a letter of reasonable assurance that the new medical school would be accredited.
