An Empirical Evaluation Of The Connecticut Death Penalty System Since 1973: Are There Unlawful Racial, Gender, And Geographic Disparities?, John J. Donohue

This article analyzes the 205 death-eligible murders leading to homicide convictions in Connecticut from 1973–2007 to determine if discriminatory and arbitrary factors influenced capital outcomes. A regression analysis controlling for an array of legitimate factors relevant to the crime, defendant, and victim provides overwhelming evidence that minority defendants who kill white victims are capitally charged at substantially higher rates than minority defendants who kill minorities, that geography influences both capital charging and sentencing decisions (with the location of a crime in Waterbury being the single most potent influence on which death-eligible cases will lead to a sentence of death), and …

When comparing patent litigation rates or “rarity” across decades, one must take into account the proportion to the actual scale of commercial activities that give rise to patent disputes. Such normalizing scales are preferably national metrics of commercial activity such as (a) the number of patents issued in the year, (b) the total number of patents in force over which disputes may arise, (c) the total number of Federal civil suits, or (d) the economic scale of the Gross National Product (GDP) in real dollars. The drug war and an increased demand for illicit drugs, mostly Cocaine and Heroin in Europe have introduced a new trend in drug trafficking worldwide. With political instability, inadequate security personnel, institutionalised corruption, widespread poverty, weak criminal justice system, weak financial controls to combat money laundering and the threat of terrorism, the ever resilient drug trade seems to have discovered Africa as its new route to the more profitable European market (Reid, 2013). At this rate, West Africa is being turned into a classical example of the Mexican case.

It has been loudly and repeatedly proclaimed by opponents that capital punishment is “unfair.” In their view, it is unfair because (1) only some murderers receive the ultimate sentence and (2) they are not the most deserving. Underlying this view is the remarkable assumption that fairness is subject to “fine tuning” and “moral accuracy.” It is argued here that this assumption is indefensible both in theory and in practice. As a theoretical matter, it is insupportable to suggest that matters of conscience, right and wrong, are subject to calibration or “accuracy.” Right and wrong are not determined in the same …

This article highlights an anomaly. It shows that two tax rules aimed to achieve a similar goal were introduced at the same time. Both meant to be temporary and bring economic stimuli, but received a dramatically different treatment. The less efficient or economically inferior survived. Its superior counterpart did not. The article reviews the reasons for this paradox. It shows that the reason is both political and an agency problem. The article not only enriches an important and ongoing debate that has received much attention in recent years, but also provides important lessons to policymakers.

This paper examines and compares, in historical context, the expansion of governmental authority in response to threats of bioterrorism, one of which is aimed directly at people, the other of which is aimed directly at agribusiness. The examination reveals that there is a historical, natural tendency of the executive branch to expand its powers and that the legislative and judicial branches tend to defer to the executive branch during emergencies. The Federal Circuit was established in 1982 as an appellate court with limited jurisdiction over patent claims. However, the Federal Circuit has used this limited jurisdiction to expand its reach into contract law, developing a federal common law of contract. Given the growing importance of patent litigation in the past three decades, this creation of an independent body of contract law creates uncertainty in transactions involving patents. The concept of sovereignty is a recurring and controversial theme in international law, and it has a long history in western philosophy. The traditionally favored concept of sovereignty proves problematic in the context of international law. International law’s own claims to sovereignty, which are premised on traditional concept of sovereignty, undermine individual nations’ claims to sovereignty. These problems are attributable to deep-seated flaws in the traditional concept of sovereignty. Die Retina ist wegen ihrer Unterscheidungskraft ein vielversprechendes biometrisches Merkmal, das vor allem für sicherheitsrelevante Systeme genutzt wird. Allerdings manifestieren sich auch zahlreiche Erkrankungen durch entsprechende Veränderungen der Retina. Die Nutzung solcher gesundheitsbezogener und für Zwecke der Authentifizierung unnötiger Daten ist daher unbedingt zu vermeiden. Dieser Beitrag befasst sich mit der Frage, welche gesundheitsrelevanten Informationen aus Retinabildern gewonnen werden können und welche Konsequenzen dies für den Entwurf biometrischer Systeme hat.

Evidence Summarized In Attorney’S Closing Arguments Predicts Acquittals In Criminal Trials Of Child Sexual Abuse, Stacia N. Stolzenberg, Thomas D. Lyon

Evidence summarized in attorney’s closing arguments of criminal child sexual abuse cases (N = 189) was coded to predict acquittal rates. Ten variables were significant bivariate predictors; five variables significant at p < .01 were entered into a multivariate model. Cases were likely to result in an acquittal when the defendant was not charged with force, the child maintained contact with the defendant after the abuse occurred, the defense presented a hearsay witness regarding the victim’s statements, a witness regarding the victim’s character, or a witness regarding another witnesses’ character (usually the mother). The findings suggest that jurors might believe that child molestation is akin to a stereotype of violent rape, and that they may be swayed by defense challenges to the victim’s credibility and the credibility of those close to the victim.

This essay argues that mixing religion in politics is problematic. It becomes destructive when the religion is unyielding and coercive. Whenever religious powers are on the rise, the foundations of liberal democracy are shaken and its protective mechanisms are regressing. Indeed, in Israel egalitarianism is still in the making. Orthodox Judaism and liberal democracy are in conflict. The rise of one comes at the expense of the other in a situation where religion does not encompass the concept of freedom from religion. In this senior project I assert that 9/11 was a turning point for the U.S. that changed the way it views warfare and security, which consequently allowed for the abuse of law and power around the globe, specifically in countries such as Yemen, Pakistan and Somalia. This article provides the first and most comprehensive analysis of Public Accounts Committees (PACs) from Eastern and Southern Africa building on the work of McGee, Jacobs, Stapenhurst, and Staddon. By analyzing an original set of data, this article shows that PACs in these two regions are bigger, have more staff members, and are more likely to be chaired by opposition Members of Parliament than they have in other countries and regions. Does public mood influence the decisions of U.S. Supreme Court Justices? Under what conditions might Justices vote against their typical ideological leanings and in favor of public opinion? We employ both quantitative and qualitative methods to address these questions. For the quantitative portion, logistic regression analysis indicates a strong relationship between public mood and Supreme Court Justices’ votes both in the aggregate and for a number of liberal and conservative Justices individually during the 1946 to 2011 Court terms. During the twentieth century, military dictatorships produced the largest number of authoritarian constitutions in Latin America. Why would military rulers invest time and resources in drafting constitutions? I argue that military leaders engage in constitution making to introduce more effective transformations of the political order during their rule and to have influence over the functioning of democracy after leaving power. However, in order to achieve all these goals, military dictators must be able to mobilize popular and partisan support for the authoritarian regime. From the Behavioral Economics point of view, this paper presents a critic to one dimension of rational choice theory that is widely accepted by Law and Economics scholars. Our hypothesis is that (i) individuals deviate anomalously but predictably of normative assumption of rational choice. We suggests that, (ii) more than –unbounded– rational self interested individuals, in certain contexts, people tend to deviate from this normative behavior and also, tend to judge the behavior of other people, according to the consistency of these behaviors with a hypothetical situation commonly referred to as the "reference transaction".
