Normalmente, somos crítico do Presidencialismo. Mas o nosso sistema parlamentarista tem um problema também: o da qualidade dos nossos representantes. O texto ficcional proposto encena as angústias de um parlamentarista que entende a política como um clubismo, mas que mesmo assim precisa de ir digerindo as escolhas das máquinas partidárias para candidatos a deputados. Obviamente tal não pretende levar água nem ao moinho dos que pretendem reduzir o seu número, tornando o parlamento numa sensaboria bicolor, nem dos que gostariam de círculos uninominais, em que seria eleitos candidatos mediáticos ou caciques locais.

It was not unexpected that the Singapore Court of Appeal would reaffirm the constitutionality of the mandatory death penalty for certain forms of drug trafficking in Yong Vui Kong v Public Prosecutor [2010] 3 S.L.R 489. ... The appellant made submissions based on Articles 9(1) and 12(1) of the Constitution, which respectively guarantee rights to life and personal liberty, and to equality before the law and equal protection of the law. This note examines aspects of the Article 9(1) arguments.

The new agency UN WOMEN must play an active role in the standardization of laws and policies at the global and national level where their incongruence has negative and often criminal consequences for the health and lives of women and girls. This article focuses in on three such examples: opt-out testing for HIV, criminalization of vertical transmission, and the new World Health Organization guidelines on breastfeeding.

Modern ethical and legal norms generally require that deference be accorded to patients' decisions regarding treatment, including decisions to refuse life-sustaining care, even when patients no longer have the capacity to communicate those decisions to their physicians. Advance directives were developed as a means by which a patient's autonomy regarding medical care might survive such incapacity. Unfortunately, preserving patient autonomy at the end of life has been no simple task. First, it has been difficult to persuade patients to prepare for incapacity by making their wishes known. Should courts have the power to examine the legislature’s enactment process and strike down statutes enacted contrary to procedural lawmaking requirements? This idea remains highly controversial. While substantive judicial review is well-established and often taken for granted, many judges and scholars see judicial review of the legislative process as utterly objectionable. This Article challenges that prevalent position and establishes the case for judicial review of the legislative process. The Article contends that, ironically, some of the major arguments for substantive judicial review in constitutional theory, and even the arguments in Marbury v. The situation of women in Israel is a complex one. While in many respects women enjoy advanced liberal citizenship rights, in other respects, especially in the domain of personal status law, they suffer from serious restrictions on their rights and from discrimination. I will argue that this discrimination is the result of Israel's commitment to maintaining its character as a Jewish state through a preservation of a Jewish majority in Israel. Many emerging areas of nanotechnology research are focusing on artificial photosynthesis as a long-term planetary renewable energy and carbon management option – by providing an alternative form of energy to both fossil fuels and biofuels and as a means of stabilising atmospheric CO2. Large research teams in many nations are using nanotechnology to actively redesign photosynthetic components such as light capture antennae, artificial reaction centre proteins, organic polymers and inorganic catalysts. On September 16, 2011, the Court of Appeals of Santiago decided "Agrupación Nacional de Empleados Fiscales y otro con Servicio de Impuestos Internos", annulling salary deductions affecting public servants that went on strike on the basis of due process. This solution, however, is unstable as it depends on the mistaken deductions made by the administration. Much less promising for public sector workers is to invoke their labor law rights, which the very Constitution constrains. This article examines various documents put forward within the context of the discussion on equal marriage currently being held at the Constitutional Tribunal and the legislative process. From this analysis, it concludes that Chilean public deliberation presents an uneven fulfillment of the standards stemming from communicative ethics, which in this article is conceptualized from the perspective of the work of Carlos Nino.

This article will demonstrate that although students of the law, legal scholars, and practitioners rely on a relatively narrow body of “legal scholarship,” there are in fact sundry diverse sources of legal thought that deserve to be evaluated along with currently accepted legal scholarship.
