Se propone una metodología para evaluar la predictibilidad de las sentencias del Tribunal Constitucional considerando la coherencia experimentada en los votos individuales de sus ministros. Tomando algunos casos considerados especialmente relevantes por especialistas consultados, y observando que los ministros disidentes no suelen modificar sus posiciones para seguir las posiciones de la mayoría en casos futuros, se concluye que la mantención de las doctrinas del Tribunal Constitucional dependerá en gran medida de la composición del mismo, y no solamente de lo que se haya expresado en sentencias precedentes.

The article examines the fundamental recommendations for the national human rights institutions (NHRI) to function with proper autonomy against the state and, also, against NGOs that try to capture the commission´s agenda. The authors analyse the institutional design of the Chilean Human Rights Institution (INDH) and evaluates the profile and the nomination process of its membership. The paper provides evidence that demonstrates that the INDH´s research agenda is associated with a partial political view. Then, the authors suggest certain changes to strengthen the independence of the INDH.

The author criticizes the power of the Chilean Constitutional Court to exercise compulsory ex-ante control of statutes, established in article 93, number 1, of the Chilean Constitution. After clarifying its special juridical nature, he analyzes the advantages and disadvantages of this system of control, using national and foreign bibliography. The existence of a constitutional seal aggravates the disadvantages. Then, he dedicates a section to study the motivation of the judgments generated in this type of control, questioning its value. Este trabajo busca reorientar el debate chileno acerca de si procede o no el control constitucional sobre los tratados internacionales. Luego de analizar las principales líneas que la doctrina y la jurisprudencia nacionales han elaborado, se concluye que el debate no logra escapar de una lógica formalista o literalista, basada en la precisión semántica de expresiones como “precepto legal”, “derechos esenciales” y “suspensión de tratados”. Los autores proponen algunos lineamientos de reforma para pasar desde el actual modelo de superintendencias hacia uno de agencias regulatorias independientes. Para ello revisan la experiencia norteamericana de agencias regulatorias independientes (independent agencies), las que no sólo son antecedentes de nuestro esquema de superintendencias –aunque “mal importadas”–, sino porque dicha experiencia puede entregar algunas luces respecto de tres aspectos fundamentales hasta ahora débilmente tratados por la doctrina chilena: estatus constitucional, autonomía política y estándares de revisión judicial del accionar de estos entes administrativos. El autor aborda el problema de la inconstitucionalidad por omisión del legislador examinando las posibilidades de solución con la normativa constitucional actual, haciendo referencias al derecho comparado y a la jurisprudencia del Tribunal Constitucional chileno. Ante la poca esperanza de una reforma constitucional, propone utilizar el mecanismo de integración del vacío o laguna legal por parte de la justicia ordinaria como una respuesta para casos particulares.

This work critically analyzes the amendment introduced by the Law 20.381 to the organic law of the Chilean Constitutional Court, in order to restore the original rule contained in 83, 3º of the Constitution, under which all points of law declared as constitutional by the Constitutional Court could not be challenged afterwards by a general action of unconstitutionality. This effect is called by the author “constitutional seal”. The author questions the constitutionality of the current rule, taking particularly into account its contextualization in the constitutional review system introduced by the constitutional reform of 2005.
