The Impact of Regulating Social Science Research with Biomedical Regulations Since 1974 Federal regulations have governed the use of human subjects in biomedical and social science research. The regulations are known as the Federal Policy for the Protection of Human Subjects, and often referred to as the "Common Rule" because 18 Federal agencies follow some form of the policy. The Common Rule defines basic policies for conducting biomedical and social science research. Intellectual property, particularly patents, plays a major role in innovation and discovery in biotechnology. Likewise, since the passage of the Bayh-Dole Act in 1981, patents have become an increasingly important factor in U.S. university-driven basic research, especially in the life sciences where patented technologies have transformed agriculture. Specifically, this paper looks at the potential impacts of these trends on university driven research, the university researcher, the pharmaceutical industry, and the farm sector with an emphasis on recent and pending court cases and legislation. The problems associated with the civil legal system for women who have experienced domestic violence have been persistent over time and still exist today. The current sociopolitical context in this state frames access to civil legal services either through a means-tested (and underfunded) program (Civil Legal Assistance) or as a privately purchased market service. This leaves a limited amount of low- or no-cost alternatives, which creates a gap in services for those women whose income is too high to qualify for Civil Legal Assistance programs, yet too low to afford to hire a private attorney. This paper explores two potential land use planning strategies that can be used to preserve and enhance the economic viability of agricultural operations surrounded by suburban development in Santa Barbara County’s Eastern Goleta Valley: buffers between agriculture and other land uses, and agritourism. In the case of buffers, academic literature is examined to determine how effective buffers are at various tasks (filtering runoff, mitigating dust and wind, providing habitat, etc.) and how to construct buffers to maximize their effectiveness. Using the testimonies surrounding the Development, Relief, and Education for Alien Minors Act (DREAM Act) as a primary case study, this project provides a rhetorical investigation of the interplay between narratives, nation building, national identity, policymaking, and the American immigrant. This project first identifies the grand narrative of exclusionary nationalism as the primary narrative constituting the American identity. Then, this project examines the rhetoric of policymakers to demonstrate how an Anglo-Saxonized, elitist notion of American identity is rhetorically constituted by assimilationist, racist, xenophobic, and classist discourses. This was an exploratory and descriptive study on stakeholders’ perceptions of political leaders’ behavior and outcomes. A purposeful sample comprised of 471 respondents whom were highly engaged in the political process was conducted on five distinct stakeholder groups, consisting of government employees, elected officials, union-building trades, business professionals, and college students. Two emergent results were identified: political party affiliation was a major indicator of stakeholder differences, and the inversion of agency theory. In the aftermath of the Abu Ghraib investigation and the 2009 CASUSS report on post-9/11 interrogation practices, the question of state-sanctioned torture has become the subject of much public and scholarly debate. In this thesis, the author examines three arguments in support of lawful torture: Alan Dershowitz’s Law of Necessity and the concept of “torture warrants,” Michael Walzer’s “problem of dirty hands,” and Richard Posner’s notion of Constitutional interpretation in times of emergency.

For decades, unresolved conflicts have negatively influenced the general public through increased violence, overwhelming the judicial system. A literature review suggested that between 15% and 20% of conflicts result in an impasse. This study was designed to understand how the implementation and application of the transformative meditation technique (TMT) is used to resolve conflicts. The purpose of this qualitative case study was to investigate the interpretation and implementation of TMT. In order to complete an implementation analysis of the T Human Trafficking Status and the U Victims of Crime Status, legislation, articles, annual reports produced by the government and its agencies, and written documents were assessed and compiled to create a framework for highlighting the significant elements of each status, a process that has not been done prior to this effort. This framework was then examined from an intervention theorist’s perspective to assess whether the statuses have been implemented in a manner that meets the goals of the authorizing legislation.

There are roughly 1,500 immigrants from Mexico and Central America currently working on farms in Vermont, helping to sustain approximately half of all milk produced in the state. But the lack of adequate visa-to-work options leaves these individuals without proper documentation to be in the US. As such, they are vulnerable to exploitation by their employers, susceptible to harassment from the communities in which they live, and under constant threat of deportation by federal immigration agents. This thesis explores the Australian State response to the voyage facilitators of maritime asylum seekers, commonly known as ‘people smugglers’. It does so by examining a number of Parliamentary debates and previously confidential Cabinet papers. Negative depictions of asylum seekers and their voyage facilitators as well as the prevailing political discourse is critically explored while Parliamentary debates are analysed using Critical Discourse Analysis. The research questions the ways Australian legislators justified the criminalisation of these voyage facilitators and investigates whether political elites were sufficiently informed about the circumstances of maritime asylum seeker journeys and the unique nature of their travel …
