Del Derecho Y La Economía Al Derecho Económico. Working Paper N. 1, Mario A. Pinzón Mapc
Del Derecho Y La Economía Al Derecho Económico. Working Paper N. 1, Mario A. Pinzón Mapc
Mario A Pinzón Camargo
The link between law and economics has been condensed in a new space of reflection that can be called a new paradigm within the social sciences, which intends to build the bridges of understanding between these two sciences. In contrast to the classical conception that states the antagonism in between them, due to their constitutive …

From Energy Sector Inquiry To Recent Antitrust Decisions In European Energy Markets: Competition Law As A Means To Implement Energy Sector Regulation In Eu, Michael Diathesopoulos
Michael Diathesopoulos
This paper presents the conceptual path followed by European Union, European Commission and European Competition Network, after the Energy Sector Inquiry (2007) towards the realisation of the objective of an Energy Internal Market, fully functional and open to competition. Firstly, we examine the findings of Sector Inquiry and then we describe how the Third Energy Package - that followed - tried to address the issues highlighted by the Inquiry and how Third Energy Package introduces a promising but complex system, in order to develop sector rules. Following the above, we proceed to a brief but close examination of 10 recent …
Relational Contract Theory And Management Contracts: A Paradigm For The Application Of The Theory Of The Norms, Michael Diathesopoulos
Relational Contract Theory And Management Contracts: A Paradigm For The Application Of The Theory Of The Norms, Michael Diathesopoulos
Michael Diathesopoulos
This paper examines management contracts as a paradigm for the application of relational contracts theory and especially of the theory of contractual and relational norms. This theory, deriving from Macauley's implications, but structured and analysed by I.R. MacNeil gives us a framework for the explanation and understanding of contractual obligations and business relations' rules and practice. After presenting the key literature about the norms theory and especially defining the content of MacNeil's norms, we define management contracts as relations, characterised by a high relational element and we explain why, investigating all their features, which make them a suitable object for …
Participatory Rural Appraisal, Ganesh Chandra
Participatory Rural Appraisal, Ganesh Chandra
Ganesh Chandra
Participation, empowerment and inclusion have become the new development buzzword. There has been a range of interpretations of the meaning of participation in development. Participatory development starts from the premise that it is important to identify and build upon strengths already present in communities. Perhaps the most widespread appearance of participation in mainstream development has been seen in the form of participatory methodologies of research, intended to gather a wide range of information from local people at their livelihoods, needs, and strengths, at the same time as 'empowering' them through a process of collaborative analysis and learning. PRA is a …
Dissemination Of Communication And Information In Inland Fisheries, Ganesh Chandra
Dissemination Of Communication And Information In Inland Fisheries, Ganesh Chandra
Ganesh Chandra
Flow of communication and information from the research station to the end user is sine qua non for the sustainable production as well as productivity enhancement in inland fisheries and the development of fishers as a whole. The resource poor who are often more in need than others of information on sustainable and low external input technologies is least likely to gain access to the information required. This has been seen particularly in the fisheries sector where the channels of information accessible to the resource poor delivered information on new practices and recommendations as well as the new culture technologies, …

Haiti Needs Socialism, David E. Clark
Haiti Needs Socialism, David E. Clark
David E Clark
Bill Clinton said that the Tsunami survivors six years ago deserved the chance to decide their own future. Haiti deserves the same hands-off approach as they rebuild after the 2010 earthquake. Aristide should be allowed to return and work with Venezuela and Cuba. If he decides to implement the same socialist reforms that have worked elsewhere in the Americas, so be it.
Rethinking The Old Age Income Security For All In Taiwan, Chih-Lung Huang
Rethinking The Old Age Income Security For All In Taiwan, Chih-Lung Huang
Chih-lung Huang
The National Pension Act of October 2008 completed a fragmentary framework for old age income security in Taiwan. Although coverage was universal, however, it was far from equal. Several different income security schemes were established, and the political process tended to lump together such contradictory institutional logics as insurance, assistance, and allowance. Advocates of an integrated universal insurance program see this piecemeal approach as a policy failure. Nonetheless, these advocates fail to take into account the fluid nature of structural social crises. This paper instead proposes a new, multi-layered division of citizen responsibility. This approach will allow citizens and the …

Agency-Specific Precedents, Robert L. Glicksman, Richard E. Levy
Robert L. Glicksman
As a field of legal study and practice, administrative law rests on the premise that legal principles concerning agency structure, administrative process, and judicial review cut across multiple agencies. In practice, however, judicial precedents addressing the application of administrative law doctrines to a given agency tend to rely most heavily on other cases involving the same agency, and use verbal formulations or doctrinal approaches reflected in those cases. Over time, the doctrine often begins to develop its own unique characteristics when applied to that particular agency. These “agency-specific precedents” deviate from the conventional understanding of the relevant principles as a …

Evaluation Of Frontline Demonstration Of Greengram (Vigna Radiata L.) In Sundarbans, West Bengal, Ganesh Chandra
Ganesh Chandra
Green gram (mungbean) is one of the important pulse crop in India, which plays a major role in augmenting the income of small and marginal farmers of Sundarban. The prevalent farming situation in Sundarban areas being characterised by kharif season with paddy cultivation in rain-fed condition and water requirement for growing rabi and summer crops are met only through residual soil moisture and/or stored rain-water. The low production of traditional varieties of greengram was a cause of concern for the farmers at large. To overcome this problem of low yield, Krishi Vigyan Kendra of CIFRI has conducted frontline demonstration field …
Framing Water Policy In A Carbon Affected And Carbon Constrained Environment, Noah D. Hall, Robert H. Abrams
Framing Water Policy In A Carbon Affected And Carbon Constrained Environment, Noah D. Hall, Robert H. Abrams
Noah D Hall
Climate change driven by greenhouse gas emissions is substantially altering water availability while increasing water demand. Shifts in domestic energy policy and production, while needed to confront the challenge of climate change, may further stress the nation’s water resources. These changes and new demands will be most severe in regions that are already experiencing water stresses and conflicts. This article examines the extent of the changes in water supply and demand by assessing how water conflicts will be addressed in the four overarching water use categories: water for population security, water for ecological security, water for energy security, and water …
Context Is Everything: Sociality And Privacy In Online Social Network Sites, Ronald Leenes
Context Is Everything: Sociality And Privacy In Online Social Network Sites, Ronald Leenes
Ronald Leenes
Social Network Sites (SNSs) pose many privacy issues. Apart from the fact that privacy in an online social network site may sound like an oxymo- ron, significant privacy issues are caused by the way social structures are currently handled in SNSs. Conceptually different social groups are generally conflated into the singular notion of ‘friend’. This chapter argues that attention should be paid to the social dynamics of SNSs and the way people handle social contexts. It shows that SNS technology can be designed to support audience segregation, which should mitigate at least some of the privacy issues in Social Network …

New Developments In Developmental Research On Social Information Processing And Antisocial Behavior, Reid G. Fontaine
Reid G. Fontaine
The Special Section on developmental research on social information processing (SIP) and antisocial behavior is here introduced. Following a brief history of SIP theory, comments on several themes—measurement and assessment, attributional and interpretational style, response evaluation and decision, and the relation between emotion and SIP—that tie together four new empirical investigations are provided. Notable contributions of these studies are highlighted.

Does Response Evaluation And Decision (Red) Mediate The Relation Between Hostile Attributional Style And Antisocial Behavior In Adolescence?, Reid G. Fontaine
Reid G. Fontaine
The role of hostile attributional style (HAS) in antisocial development has been well-documented. We analyzed longitudinal data on 585 youths (48% female; 19% ethnic minority) to test the hypothesis that response evaluation and decision (RED) mediates the relation between HAS and antisocial behavior in adolescence. In Grades 10 and 12, adolescent participants and their parents reported participants’ antisocial conduct. In Grade 11, participants were asked to imagine themselves in videotaped ambiguous-provocation scenarios. Segment 1 of each scenario presented an ambiguous provocation, after which participants answered HAS questions. In segment 2, participants were asked to imagine themselves responding aggressively to the …

Copyright And Education: Lessons On African Copyright And Access To Knowledge, Jeremy De Beer, Dick Kawooya, Tobias Schonwetter, Achal Prabhala
Jeremy de Beer
The African Copyright and Access to Knowledge (ACA2K) project is a pan-African research network of academics and researchers from law, economics and the information sciences, spanning Egypt, Ghana, Kenya, Morocco, Mozambique, Senegal, South Africa and Uganda. Research conducted by the project was designed to investigate the extent to which copyright is fulfilling its objective of facilitating access to knowledge, and learning materials in particular, in the study countries. The hypotheses tested during the course of research were that: (a) the copyright environments in study countries are not maximising access to learning materials, and (b) the copyright environments in study countries …

Emerging Law Addressing Climate Change And Water, Prof. Elizabeth Burleson
Emerging Law Addressing Climate Change And Water, Prof. Elizabeth Burleson
Prof. Elizabeth Burleson
The World Economic Forum recognizes that while restrictions on energy affect water systems and vice versa, energy and water policy are rarely coordinated. The International Panel on Climate Change predicts that wet places will become wetter and dry places will become dryer. Transboundary water, energy and climate coordination can occur through international consensus building.
Most Claims Settle: Implications For Alternative Dispute Resolution From A Profile Of Medical Malpractice Claims In Florida, Mirya R. Holman, Neil Vidmar
Most Claims Settle: Implications For Alternative Dispute Resolution From A Profile Of Medical Malpractice Claims In Florida, Mirya R. Holman, Neil Vidmar
Mirya R Holman
The public image of medical malpractice cases is one of a courtroom, with an injured plaintiff, lawyers, and a judge. However, the reality of malpractice claims is very different. Approaching the study of alternative dispute resolution methods for medical malpractice claims with an eye towards identifying those contexts by which the claims are resolved, this article focuses on the institutional and informal processes of resolving disputes. These processes include both statutory procedural requirements and informal settlements, many of which occur prior to the filing of a lawsuit. A profile of medical malpractice claims in Florida from 1990 through 2008, indicates …
