Israel's Voice Muffled Amid Hail Of Stones: Distortion: Confronted With A Campaign Of Violence And Propaganda, Israel Goes Unheard In The Court Of World Opinion, Kenneth Lasson
All Faculty Scholarship
"I am in the U.S. until February. A few weeks ago, I went to our embassy in Washington and offered to speak on Israel's behalf, to present the true story of what's going on, to counter the very effective job being done by the Palestinians of making it appear as if they are Davids fighting Goliath, and we are not getting the truth out. But the people at the embassy just shrugged."
He knows that in 1948 some 630,000 Arab refugees were encouraged to leave Israel by their leaders, who promised to purge the land of Jews. Instead, they became …
The Second Amendment: Structure, History, And Constitutional Change, David Yassky
The Second Amendment: Structure, History, And Constitutional Change, David Yassky
Michigan Law Review
A fierce debate about the Second Amendment has been percolating in academia for two decades, and has now bubbled through to the courts. The question at the heart of this debate is whether the Amendment restricts the government's ability to regulate the private possession of firearms. Since at least 1939 - when the Supreme Court decided United States v. Miller, its only decision squarely addressing the scope of the right to "keep and bear Arms" - the answer to that question has been an unqualified "no." Courts have brushed aside Second Amendment challenges to gun control legislation, reading the Amendment …
The Status And Needs Of Small Businesses Owned And Controlled By Disabled Veterans, Paul R. Camacho
The Status And Needs Of Small Businesses Owned And Controlled By Disabled Veterans, Paul R. Camacho
William Joiner Institute for the Study of War and Social Consequences Publications
This introduction provides a thumbnail sketch, or landscape, of the history and conditions of veterans’ benefits against which to profile the issue of veterans’ small business opportunities. After years of applied research on issues pertaining to the veteran community, it has become abundantly clear to this researcher that the good people who serve in our federal and state agencies, and as staff persons in various congressional and state legislative offices often lack the data and/or information they need to fully and meaningfully address the needs of veterans and their families. This situation is no doubt a result of demographic facts. …

Holocaust Deniers Can't Be Ignored: History: As Victims And Witnesses Of World War Ii Die Off, Revisionist Views Of The Nazi Horrors Could Gain Broader Acceptance, Kenneth Lasson
All Faculty Scholarship
On trial in an English courtroom, where British historian David Irving has sued American professor Deborah Lipstadt for defamation, is not only the scholars' reputations but history itself. Irving claims that he was libeled by Lipstadt's 1993 book, "Denying the Holocaust: The Growing Assault on Truth and Memory," in which she called him "one of the most dangerous of the `revisionists'" because, "familiar with historical evidence, he bends it until it conforms with his ideological leanings and political agenda." But under British law, the burden of proof in defamation is squarely on the defendant, thus making it necessary for Lipstadt …
Of Law, Lawlessness, And Sovereignty : Multinational Peacekeeping And International Law, Antje Mays
Of Law, Lawlessness, And Sovereignty : Multinational Peacekeeping And International Law, Antje Mays
Dacus Library Faculty Publications
Laws of war have been carefully defined by individual nations’ own codes of law as well as by supranational bodies. Yet the international scene has seen an increasing movement away from traditionally declared war toward multinational peacekeeping missions geared at containing local conflicts when perceived as potential threats to their respective regions’ political stability. While individual nations’ laws governing warfare presuppose national sovereignty, the multinational nature of peacekeeping scenarios can blur the lines of command structures, soldiers’ national loyalties, occupational jurisdiction, and raise profound questions as to which countries’ moral sense/governmental system is to be the one upheld. Historically increasingly …
International Security And The War Powers Resolution, Alexander C. Linn
International Security And The War Powers Resolution, Alexander C. Linn
William & Mary Bill of Rights Journal
In recent history, the authority to commit US. troops to theaters of conflict has shifted from Congress to the President. After the Vietnam War, the War Powers Resolution was written to reestablish balanced authority over war between the political branches of government. In the post-Cold War era, forces frequently are deployed as part of multilateral UN. operations. This trend creates two contradictory needs: first, the need for the Executive to be able to act swiftly and decisively in formulating military commitments to the United Nations, and second, the need for Congress to authorize potentially long-term military deployments. To reconcile these …

Soldiers For Justice: The Role Of The Tuskegee Airmen In The Desegregation Of The American Armed Forces, F. Michael Higginbotham
William & Mary Bill of Rights Journal
Often noted for their heroic prowess as pilots in World War II, the Tuskegee Airmen served just as nobly fighting racial segregation within the Army. Considered exemplary in its integration today, the armed forces were a testing ground for integration in the middle of the twentieth century. Black officers and enlisted men, putting themselves in harm's way for a segregated United States, rebuked the notion of separate but equal, thereby slowly paving the way for integration in the military, and eventually, the nation. In this Article, F. Michael Higgenbotham examines the history of segregation in the United States Armed Forces …

Orientalism Revisited In Asylum And Refugee Claims, Susan M. Akram
Faculty Scholarship
This article examines the stereotyping of Islam both by advocates and academics in refugee rights advocacy. The article looks at a particular aspect of this stereotyping, which can be seen as ‘neo-Orientalism’ occurring in the asylum and refugee context, particularly affecting women, and the damage that it does to refugee rights both in and outside the Arab and Muslim world. The article points out the dangers of neo-orientalism in framing refugee law issues, and asks for a more thoughtful and analytical approach by Western refugee advocates and academics on the panoply of Muslim attitudes and Islamic thought affecting applicants for …
