Following the Enlightenment, Western adherence to positivist theory influenced practices of Western research and documentation. Prior to the introduction of positivism into Western scholarship, innovations in printing technology, literary advancements, and the development of capitalism encouraged the passing of copyright statutes by nation-states in fifteenth century Europe. The evolution of copyright and positivism in Europe influenced United States copyright and its protection of the author, as well as the practice of archiving and its role in interpreting history. Because Native American cultures practiced orality, they suffered the loss of their traditional knowledge and cultural expressions not protected by copyright. By …

Whether providing services or resources, every library is faced with questions of selecting the right resource for the right reason. You need a website, a process for updating content, a way to manage operations, and a system for responding to constant change. Increasingly, new service opportunities are found in cloud and virtual platforms. This presentation looks at opportunities in selecting the right tools for the right job. The presentation will explore some unique aspects of law libraries and legal subject content many libraries rely on, including the strategic value of content from law libraries in metropolitan areas.

On November 14, 2013, the Washington and Lee Law Library hosted a first-of-its-kind Fall Scholarship Celebration. The event took place in the Law Library's main reading room from 5:00 p.m. to 7:00 p.m.

On display were dozens of scholarly articles, books, chapters, and amicus briefs authored by the W&L Law faculty and student body during 2012 and 2013, with hundreds of additional works accessible online through the Scholarly Commons institutional repository.

Concentration On The Las Vegas Strip: An Exploration Of The Impacts, David G. Schwartz

Looking at two snapshots, albeit from a distance, gives an overview of how concentrated the gaming industry in Nevada has become:

• In 1998, 23 publicly held corporations owned 65 casinos that grossed more than $12 million that year from gaming. These casinos grossed 75.48% of the state’s total gaming revenue that fiscal year.

• In 2012, 22 publicly held corporations owned 70 casinos that grossed more than $12 million that year from gambling, pulling in 78.0% of that state’s total gaming revenue that fiscal year.

The federal government has had a curious relationship with gambling. For much of its history, the national public policy towards gambling was simple: prohibition, despite the audacity of a few laggard states in experimenting with legalization schemes. Towards the end of the twentieth century, however, the national policy shifted, at first to tolerance of legal gambling to endorsement of it. It appears beyond dispute that under the current federal system small copyright claimants face formidable challenges in seeking to enforce the exclusive rights to which they are entitled. The Copyright Office therefore recommends that Congress consider the creation of an alternative forum that will enable copyright owners to pursue small infringement matters and related claims arising under the Copyright Act. Ontario's Freedom of Information and Protection of Privacy Act regulates information privacy and access to information in the public sector. It applies to information held by the provincial government and its agencies, including colleges and universities. Provincial institutions must delegate an officer to handle such requests, and deal directly with the individual who is seeking access. Appeals of the institution's decision are handled by the Ontario Information and Privacy Commissioner. This workshop will cover the process of filing a formal information request, tips for ensuring that you obtain relevant
records, and how to challenge an institution's decision to withhold information.

The Georgia State University Copyright Case (Cambridge University Press V. Becker) And What It Means For Librarians, Judson L. Strain

Faculty Scholarship – Library Science

The Federal District Court in the Georgia State University copyright case (Cambridge University Press v Becker) constructed a carefully defined, but expansive Fair Use “safe harbor”. Academic libraries and not-for-profit educational institutions can use this “safe harbor” to make copies of copyright-protected materials and distribute them to students in a carefully controlled manner. The decision requires safeguards to help ensure that copies do not get disseminated beyond their intended audience. It also gives more flexibility in cases where publishers do not make smaller excerpts readily available.

Foreign, comparative, and international law (FCIL) librarianship has grown in importance along with the increased emphasis on global legal research. As the field moves forward, it is important to develop core competencies in FCIL librarianship. These core competencies will provide a common knowledge base among librarians throughout the world. New developments in technology, culture, and legal research necessitate a fresh look at the skills required to be successful in FCIL librarianship. This will then permit a wide range of information professionals to acquire an expertise in FCIL librarianship, through a certification process based on the attainment of these core competencies.

E-books are not just for popular reading; legal publishers are entering the e-book market as well. Major publishers are launching e-book platforms and offering law libraries the opportunity to purchase both individual titles and collections of electronic books that they also offer in print. With increasing signs of a strong future for e-books, and possibly for e-lending as well, in spring 2012 Cornell Law Library decided to pilot OverDrive for the Cornell Law School community.
