Adding Legal Research To The Bar Exam: What Would The Exercise Look Like?, Patrick J. Meyer

Various authors have criticized the current bar exam format for not testing law practice skills. This is in spite of the ground-breaking MacCrate Report, the seminal publication of the practice-ready movement, which nearly 30 years ago listed ten fundamental practice skills. One of these ten Fundamental Lawyering Skills is legal research, which is still not tested on bar exams. The focus of this article will be on deficiencies pertaining to a lack of legal research readiness in the practice of law. This article proposes a teaching technique for use in large, Socratic-style law school classes to embed exam preparation, formative assessment, and lawyering simulations in the course without overburdening the professor or students. This technique is sustainable, yet highly efficacious for students.

Law schools nationwide are implementing new reforms pushing law schools toward stronger assessment techniques and client-based simulations better preparing students for the practice of law. This study aid provides candidates with a complete guide to the bar exam - from pre-planning considerations through bar review and sitting for the exam. Every aspect of the process is explained in detail and by example. The bar exam is deconstructed, section by section, where candidates are led through the steps they need to follow to succeed. This article advocates that law schools should provide bar exam preparation for students, including instruction regarding effective writing for bar exams. Using the reader expectation approach and considering the unique conventions of the legal profession's discourse community as a theoretical backdrop, this article examines effective writing for bar exams. It also provides practical recommendations for instructing students to write effective bar exam answers.
