A few semesters ago I was discussing the value of secondary sources with a student when they paused to think, then described secondary sources as “kind of like the 80/20 Rule, but different.” I’d never heard of the 80/20 Rule, but I jotted it down onto a Post-It note to look into later. Fast-forward to today and I now introduce my students to what I’ve dubbed “the 80/20 Rule for Legal Research” in all classes about secondary sources.

At the Teaching the Teachers Conference a few weeks ago, I gave a demonstration of a formative assessment style we’ve been using at my institution for the past year and a half: a live assignment, AKA the Research Practicum. The presentation was virtual; COVID struck, of course, and I couldn’t get on a plane and fly to Portland. Fortunately, the nature of this assessment lends itself beautifully to a pivot to virtual because it is already entirely virtual. Last month, I posted to this blog the results of my study comparing the salaries of tenure-track law professors and law librarians who teach required, credit-bearing classes. The reaction was overwhelming; clearly, the proof that law librarians were underpaid – something many librarians had assumed for many years – hit a chord within the profession. When I started in my current role as an instructional librarian, I was given space to make the changes I thought necessary to improve an already-changing legal research program. I’ve made changes – some small, some more major – in both the 1L and upper-level research curriculum, but there is more to do. Abstract
In the 2018-2019 revision of the American Bar Association (ABA) Standards and Rules of Procedure for Approval of Law Schools, the ABA further relaxed the requirements relating to distance education in J.D. programs. However, outside of a handful of schools that have received permission to teach J.D. courses almost entirely online, most experiments in distance legal education have occurred in post-graduate (i.e. post-J.D.) programs: LL.M. degrees, and various graduate certificates and Master’s degrees in law-related subjects. These programs can be taught completely online without requiring special ABA permission.

From online embeds to interactive displays, timelines can serve many purposes and tell powerful stories. At the University of Georgia’s Law Library we have teamed up with faculty and staff to bring history to life, engage students, and preserve scholarly and institutional milestones. Through trial and error we have found a variety of tools for creating timelines digitally. In this article we share our four favorite web-based applications for creating timelines including Tiki-Toki, TimeToast, Prezi and Piktochart.

In this session librarians team up with an archivist and a clinician to bring history to life, engage students, and preserve the scholarly and institutional milestones. A variety of tools for creating digital timelines and gathering content will be shared including TikiToki, TimeToast, and Piktochart. After nearly fifteen years of teaching first-year and upper-level legal writing courses and commenting on thousands of student papers, I decided to experiment with a new way of giving feedback. In a break from the traditional written feedback I had become accustomed to in the form of margin comments and a combination of line edits and end notes, I opted to live a little and learn a new practice: live critiquing. Our students have to learn so many new skills to be successful in law school and law practice. Legal research, client interviewing, and case analysis just for starters. Our teaching methods have to engage our students while preparing them to “think like a lawyer.” We also have the responsibility to familiarize students in evaluating the “benefits and risks associated with relevant technology” and to develop efficient practices and processes. Research Analysis And Planning: The Undervalued Skill In Legal Research Instruction, Robert M. Linz

This article describes a method of research analysis and planning for legal problems. It introduces the framework of research plan, log, and product and provides a detailed research plan and log that students can use as a template for learning research. The article suggests how to teach the method in legal research classes, shares some of the author's experiences in teaching the method, and addresses some possible criticisms of this approach.

When I began teaching at the University of Massachusetts in August 2012, one of my first encounters was with the newly-formed UMass Law Review. The editorial staff was wrapping up its initial preparations for publishing the inaugural volume. Now, over a year later, those nascent processes have since been refined; the inaugural year is over. Legal instructors have been urged to incorporate peer reviewing into law school courses as a way to provide students much needed feedback. Peer review can benefit legal education, but only if law school instructors adopt peer review on a large scale, and for that, computer-supported peer review systems are crucial. These web-based systems orchestrate the mechanics of students submitting written assignments on-line and distributing them to other students for anonymous review, making it considerably easier for instructors to manage.
Beyond the problem of orchestrating mechanics, however, a deeper obstacle to widespread acceptance of peer review in legal education is the …

Disaster law is fun to teach but it has a serious purpose. Emergencies will inevitably arise but how society responds to them will determine whether or not they become full-blown disasters. Training law students to adapt to dynamic situations will give them the skills they need in a world facing global warming, resource depletion, and a burgeoning population. By creating a more robust legal system, we can create a more resilient society.

It seems like more and more people today are selecting their legal research results based on ease of access rather than the completeness of the results. After hearing one too many third-year law students say "I researched my entire paper on Google," I set off to create a tool that would satisfy both the desire for speed and the need for complete and authoritative research results. Teaching Legal Research And Writing With Actual Legal Work: Extending Clinical Education Into The First Year, Michael A. Millemann, Steven D. Schwinn

In this article, the co-authors argue that legal research and writing (LRW) teachers should use actual legal work to generate assignments. They recommend that clinical and LRW teachers work together to design, co-teach, and evaluate such courses. They describe two experimental courses they developed together and co-taught to support and clarify their arguments. They contend that actual legal work motivates students to learn the basic skills of research, analysis and writing, and thus helps to accomplish the primary goals of LRW courses. It also helps students to explore new dimensions of basic skills, including those related to the development and …
