This Article proceeds in five parts. Part I considers four prominent theories on the meaning of "access to justice." To be sure, the lines and divisions between these positions are in practice less rigid than this text will at times suggest. Nonetheless, the four approaches are sufficiently different from one another to justify a critical evaluation. Part I therefore undertakes to provide such an evaluation of these different proposals. Renters who remain at a property when they no longer have a legal right to reside at the location may be sued for unlawful detainer. Most often, an unlawful detainer is filed against a renter who is no longer paying rent but continues to occupy a residence. A person may also be the subject of an unlawful detainer if they commit or allow the commission of illegal activity at a rental property. The Uniform Land Security Interest Act (ULSIA or Act) seeks to improve the collection process in cases of default; indeed, most of the text and commentary of the Act deals with that topic. ULSIA has the blessings of the American College of Real Estate Lawyers and the Real Property Section of the American Bar Association. However, though it was first promulgated in 1985, the Act has not yet been adopted in any jurisdiction, nor has it received much consideration in the law reviews or trade journals.
