Reflections On Professor Chroust's The Rise Of The Legal Profession In America, Donald P. Kommers

A review of Anton-Herman Chroust’s 1965 study on lawyers and the status of the legal profession in the United States from early colonial days to 1830.
Though the review praises the wealth of facts and detail in the work it argues that Chroust is more interested in glorifying the early American legal profession rather than analyzing the conditions for its growth. It also contends that Chroust does not organize his material according to a coherent theory or conceptual scheme. The review, in addition, asserts that Chroust focuses too much on the pious and self-righteous rhetoric lawyers at the time, assuming …

In a recent article appearing in The Student Lawyer Journal, Dean John G. Hervey of the Oklahoma City University School of Law presented what, on first reading, appeared to be a very well documented argument in support of the uniform awarding of the Juris Doctor (J.D.) as the first degree in law. There can be little quarrel with Dean Hervey's statistical abstracts which he uses to build the central thesis of his article. The Problem Of Communications In Meeting The Information Requirements Of The Courts, Layman Allen

My remarks are addressed to one aspect of the general problem of communication involved in meeting the information requirements of the courts. It transcends merely the court; however, it is a problem throughout the legal decision-making system. The efficiency of t:ourts in processing information is just one part of a larger picture of effective communication within the legal system. Phrased broadly, the question involves discerning the optimum man-machine mix in the processing of information. Nobody can reasonably quarrel with the goal of taking the fullest possible advantage of the benefits of emerging technology, as long as objectives of greater importance …
