Enhancing The Law Student Experience And Employability Skills Through A Law Clinic And Experiential Learning Curricula, Francina Cantatore

Francina Cantatore

Students have identified many positive benefits in the Bond Law Clinic initiative, including the opportunity for students to: “work in a supportive, safe and encouraging environment” (Law Student, 2013); “build confidence to distill real issues and to assist clients in finding practical answers” (Law Student, 2014); “practically apply the professional skills that they learn throughout their degree in a legal setting” (Law Student, 2013) The Clinic “is an excellent learning tool for students and a much needed service for the community” (Law Student, 2014).

Taming The Tigers: Domestic Violence, Legal Professionalism, And Well-Being, Jill Engle Jan 2016

Taming The Tigers: Domestic Violence, Legal Professionalism, And Well-Being, Jill Engle

Jill Engle

Domestic violence kills thousands of American women every year. In 2013, one of them was my client. My law school clinic represented a woman divorcing her abusive husband after twenty years of marriage. Three days after we served him with the divorce complaint, he walked into the grocery store where she worked and shot her dead. He then turned the gun on himself, and died from self-inflicted gunshot wounds. The lead student working her case listened in horror as one of our local colleagues who had heard the breaking news described it to her in a phone call to the …

The Corporate Conspiracy Vacuum (Formerly "Corporate Conspiracy: How Not Calling A Conspiracy A Conspiracy Is Warping The Law On Corporate Wrongdoing"), J.S. Nelson Sep 2015

The Corporate Conspiracy Vacuum (Formerly "Corporate Conspiracy: How Not Calling A Conspiracy A Conspiracy Is Warping The Law On Corporate Wrongdoing"), J.S. Nelson

J.S. Nelson

The intracorporate conspiracy doctrine immunizes an enterprise and its agents from conspiracy prosecution based on the legal fiction that an enterprise and its agents are a single actor incapable of the meeting of two minds to form a conspiracy. The doctrine, however, misplaces incentives in contravention of agency law, criminal law, tort law, and public policy. As a result of this absence of accountability, harmful behavior is ordered and performed without consequences, and the victims of the behavior suffer without appropriate remedy.
This vacuum at the center of American conspiracy law has now warped the doctrines around it. Especially in …

The Aba Guidelines And The Norms Of Capital Defense Representation, Russell Stetler, W. Bradley Wendel

W. Bradley Wendel

The ABA Guidelines for the Appointment and Performance of Defense Counsel in Death Penalty Cases (“Guidelines”), as revised in 2003, continue to stand as the single most authoritative summary of the prevailing professional norms in the realm of capital defense practice. Hundreds of court opinions have cited the Guidelines. They have been particularly useful in helping courts to assess the investigation and presentation of mitigating evidence in death penalty cases. This Article will discuss how these Guidelines have come to reflect prevailing professional norms in this critical area of capital defense practice and how that practice has developed in the …

Choosing The Top Candidate: Best Practices In Academic Law Library Hiring, Ronald Wheeler, Nancy Johnson, Terrance Manion Oct 2014

Choosing The Top Candidate: Best Practices In Academic Law Library Hiring, Ronald Wheeler, Nancy Johnson, Terrance Manion

Terrance K Manion

The authors discuss successful hiring practices in academic law libraries. Their discussion details each step of the hiring process, from vacancy to offer, and explores strategies for implementing the steps successfully. The processes examined include: reviewing the vacancy, assessing the library needs, forming an effective search committee, writing a winning job description, checking references, conducting an interview, and making an offer. The authors assert that a successful hire will influence every aspect of your library and, as such, a library needs to devote considerable attention and resources to librarian searches.

The Disability Dilemma: A Skeptical Bench & Bar, Wendy Hensel Oct 2014

The Disability Dilemma: A Skeptical Bench & Bar, Wendy Hensel

Wendy F. Hensel

The legal profession is no stranger to the bias and prejudice present in American society. Members of the bar have been shown to engage in both conscious and subconscious discrimination, posing challenges to the profession as the profile of those practicing law has changed over the last several decades. Although women and minorities have made significant inroads into the profession, attorneys with disabilities remain the "forgotten diversity group." Many members of the bar continue to believe that these attorneys are primarily limited by their medical problems rather than any bias in the profession. They do not embrace disability as a …

Equipping Students For The Real World: Using Scaffolding Experimental Approach To Teach The Skill Of Legal Drafting, Tammy Johnson, Francina Cantatore Apr 2014

Equipping Students For The Real World: Using Scaffolding Experimental Approach To Teach The Skill Of Legal Drafting, Tammy Johnson, Francina Cantatore

Francina Cantatore

This article responds to the difficulty that lawyers sometimes face in maintaining the balance between protecting their clients’ legal interests and translating complex legislative provisions into plain language that conveys the appropriate message to the intended audience. Using the example of a consumer credit contract transaction, Part II highlighted common drafting challenges. With these difficulties in mind, Part III discussed the theory of teaching legal skills, with a particular focus on teaching the skill of legal drafting, suggesting that a scaffolded experiential approach to skills development is an effective way to nurture the development of students’ legal drafting skills.

Chinese Courts' Role In Financial Reform: On The First "Vam Agreement" Case In China, Siyi Huang Feb 2014

Chinese Courts' Role In Financial Reform: On The First "Vam Agreement" Case In China, Siyi Huang

Siyi Huang

Traditional belief is that courts in authoritarian regimes are only passive institutions and their authority and influence are extremely limited. Despite the conventional wisdom, it’s been noticed that Chinese courts have played a crucial role in China’s financial reform. Drawing on insights from the judgments of three Chinese courts at different levels on the first “value adjustment mechanism” case in China, this article attempts to explore the functional techniques and decision-making process of Chinese courts. The analysis of the court’ judgments suggests that Chinese courts have performed a policy-making function in deciding controversial economic cases, by transcending social and business …

The Social Media Frontier: Exploring A New Mandate For Competence In The Practice Of Law, Jan Jacobowitz, Danielle Singer Feb 2014

The Social Media Frontier: Exploring A New Mandate For Competence In The Practice Of Law, Jan Jacobowitz, Danielle Singer

Jan L Jacobowitz

Attorney Mark O’Mara’s use of social media as part of the defense strategy in the representation of George Zimmerman, who was prosecuted for the death of Trayvon Martin, highlighted the use of social media in the practice of law, and because of the tremendous media coverage of the trial, facilitated a robust conversation on whether the legal profession’s use of social media is the “new normal.” In fact, lawyers’ increasing use of social media is evidenced by a growing body of case law, ethics opinions, and journal articles discussing the propriety of using social media in areas such as investigation, …
